海归博士干起了“老本行”
45岁的蒋礼先是美国某著名大学的生物学博士,在该大学获博士学位后留校任教,后于2015年回国,被一家大型制药企业聘用为技术总监。该企业为蒋礼先准备了专门的实验室和科研启动资金,供其从事新产品研发。
2016年3月的一天,蒋礼先被拉进一个QQ群,群里不断有人向他咨询瘦脸针的事情,问的人多了,蒋礼先就萌生了自己研发“瘦脸针”的想法,毕竟这是自己的老本行,做起来轻车熟路。
说干就干,蒋礼先查阅了相关的资料、文献,最后发现一种新型原料在美容除皱方面有作用,结合自己的专业知识,蒋礼先购买了相关的试剂开始进行实验,进一步研究“瘦脸针”的配方。一个月后,蒋礼先在实验室里配制出“瘦脸针”水剂,但并未进行临床试验。
研制成功之后,蒋礼先第一次就配制了4升“瘦脸针”水剂,然后联系某生物科技公司,以化妆品原料的名义签订加工合同,由该公司将蒋礼先配制的水剂按照每瓶1毫升的容量制作成4000瓶冻干粉。经查,从2016年4月至8月案发,该公司共为蒋礼先加工31.9万余支冻干粉。
微信群里低价推销
研制出“瘦脸针”后,蒋礼先开始在微信群里推销。由于微信群里讨论的瘦脸针都是肉毒素,市场上普遍认可的瘦脸针也是肉毒素,蒋礼先在与客户沟通时也就默认自己研制的“瘦脸针”为肉毒素,称自己的是精仿肉毒素。
有客户订货后,蒋礼先根据客户的要求,将“瘦脸针”成品用7毫升的玻璃瓶分装,并通过快递发货。瓶身没有任何文字、图案标记,只是根据紫色和白色瓶盖区分,实质上没有任何区别。
蒋礼先研制的“瘦脸针”成本约13元一支,售价近40元一支。由于售价远低于市场价,销售异常火爆。至案发前,蒋礼先一共销售其自制的“瘦脸针”30多万支,获利700余万元。其中仅赵某(另案处理)一人就从蒋礼先处购买“瘦脸针”10万余支,向蒋礼先支付货款330余万元。
由于业务繁忙,蒋礼先把亲戚陈艳辉叫来帮忙,安排陈艳辉在微信群里打广告、销售“瘦脸针”。有客户要货,陈艳辉就把客户的要求发给蒋礼先,由蒋礼先负责发货。蒋礼先除每月支付陈艳辉3000元固定工资外,还按照陈艳辉销售的数量给陈艳辉提成,截至案发,陈艳辉共销售“瘦脸针”6万余支,获利五六万元。
自印包装加价销售
自2016年4月开始,赵某开始从蒋礼先那里购买裸瓶“瘦脸针”,为了卖个好价钱,赵某委托他人印刷了市面上常见的两个品牌肉毒素的包装盒,并根据客户的需要进行包装后加价销售。赵某先后租了两个仓库用于存放购进的“瘦脸针”,并找来赵华春、刘杰、侯少朋等人负责包装、根据赵某的安排给客户发货。后来赵某将赵华春等三人也拉进了专门卖美容产品的微信群,并教会了他们如何在网上销售。赵某只收自己事先定好的底价,差价归赵华春三人各自所有。
在利润的驱使下,赵华春三人除了完成包装、发货的任务外,自己也开始通过微信销售“瘦脸针”,进价30多元一支的裸瓶“瘦脸针”,最高卖到近200元一支。至案发前,赵华春共销售2万余支,涉案价值达100余万元,通过加价销售累计销售2000余支,非法获利达1万余元。刘杰累计销售5000余支,涉案价值达30余万元,并通过加价销售方式销售1000余支,获利4万余元。侯少朋累计销售2000余支,涉案价值达10万余元,并通过加价销售方式销售80余支,获利6000余元。
据了解,国家对药品的新药研发、生产原料、生产工艺、运输贮存均有严格规定,蒋礼先生产的“瘦脸针”为注射用针剂,且未经临床试验,收货发货均通过快递进行,不符合药品运输的条件,对人体存在很大安全隐患。
