三证齐全的一个月后，徐应生收到资溪县国土局下发的责令退还被征土地的一纸通知。明明已经经过国土局批准的建设用地，怎么突然变成了被征土地？徐应生向上级国土部门抚州市国土局反映情况，资溪县国土局副局长带人到现场查看之后，表示“弄错了”。
一场误会还没算完。资溪县国土局再次下发责令停止违法行为通知书，理由是徐家涉嫌违反《土地权属争议调查处理办法》，必须停止建房。
徐应生第二次向法院递交了起诉状，这一次的被告是资溪县国土局。懂法的老徐发现，资溪县国土局适用法律明显不当，权属纠纷主要是使用权和所有权的纠纷，徐家建房用地是农村集体所有的土地，所有权无可争议。至于使用权，政府部门已经批准同意建房，权属非常明确，也根本不存在争议。
官司的结局和上次颇为相似，资溪县国土局撤销了责令停止违法行为通知书，徐应生撤诉。

至于缘何大动干戈、费尽周折要徐家停止建房，徐应生认为，首先这块土地的经济价值让当地政府想收回，其次也是彰显官员权威。
