记者获悉，苏红因受贿罪一审被二中院判处有期徒刑8年，并处罚金百万。此前苏红受审时哭泣认罪。法院认定其有立功情节，且全额退赃，对其从轻处罚。

借审批航线受贿500余万
苏红，1965年出生于四川省江津县，研究生文化，原系中国民用航空局运输司国内航空运输处处长。因涉嫌犯受贿罪，2015年9月15日被指定居所监视居住，同年11月2日被逮捕。
法院审理查明，2000年至2015年，被告人苏红利用担任中国民航局运输司国内运输处主任科员、助理调研员、副处长、处长职务上的便利，为四川省恒翔航空服务有限公司（以下简称恒翔航空公司）、中国民航中南管理局财务处原处长刘某等单位和个人在航空运输业务申请、航线航班经营许可、定期航班计划、节假日加班航班审批等方面提供帮助。
为此，苏红非法收受上述单位和个人给予的现金、汇款等财物共计人民币519万余元。
据记者了解，检方指控苏红受贿549万余元。但其中一笔贿款中，行贿为苏红花180余万买房后，苏红归还了30万。因此，法院认定其受贿金额为519万余元。
受贿事实
2005年至2009年 为恒翔航空公司在航线航班经营许可、节假日加班航班审批等方面提供帮助。在此期间，苏红在朝阳水碓子北里其家附近、首都机场2号航站楼到达厅，先后两次收受恒翔航空公司原法定代表人吴某给予的人民币共计250万元。
2003年至2010年 为深圳市广通联航空服务有限公司法定代表人林某在获取航班航线评审结果信息等方面提供帮助。在此期间，苏红在深圳市某酒店、朝阳水碓子其家附近等地，先后收受林某给予的现金及汇款共计人民币174万余元。
2001年至2012年 为四川航空股份有限公司及该公司工作人员张某在航线航班业务审批等方面提供帮助，并在中国民航局她的办公室等地，先后收受张某及四川航空公司工作人员伍某给予的钱款共计人民币31万余元。
2000年至2014年 为上海春秋国际旅行社有限公司、春秋航空股份有限公司国内及港澳台航空运输业务申请、航线航班经营许可、定期航班计划、节假日加班航班等审批事项上提供帮助，先后在她的办公室等地，收受上述单位3名工作人员给予的钱款共计35万元。
2001年至2013年 为均瑶集团天龙航空服务公司、上海吉祥航空股份有限公司航线航班计划申请审批等方面提供帮助，并先后在北京市华侨大厦、她的办公室等地收受上述单位工作人员给予的钱款、加油储值卡共计价值人民币12万元。

2000年至2009年间 为汕头市旅游（集团）公司（以下简称汕头旅游公司）航线航班经营许可审批等方面提供帮助，并先后在北京市华侨大厦等地收受上述单位工作人员给予的钱款共计人民币6万元。
受审落泪 称心中有愧
记者了解到，15年间，对苏红行贿的人员和单位有航空公司老总、机票代理商，其中不乏上海吉祥、四川航空、春秋航空等航空公司，而行贿多以“过节费”的名义被送出，贿款有现金、加油卡、房产等。
苏红说，受贿的钱财，她用于消费和买房。
受贿前，苏红住在一套不够家人居住的小房子里，后通过收受和购买，苏红又拥有了3套百万房产。
在法庭上，她称贿款以逢年过节拜年的形式送来，也拒绝过，但中国是个人情往来的社会……
苏红称受贿后“心里有愧，我本身不想参与钱权交易，受贿后于心不安，一直通过工作弥补，也获得单位的认可”。
一航空公司多人行贿
据记者了解，为了能够拿到紧俏的航线，多家航空公司向苏红行贿。其中一家航空公司有多人向苏红行贿，求其关照。
春秋航空公司航线计划处一副总经理周某在证言中称，春秋航空公司向民航局申请开通国内航线航班，主要是由运输司国内处进行审核和许可发放。2008年至2012年，其先后在中国民航局苏红的办公室等地，送给苏红共计18万元。该公司运力网络部经理刘某也曾2次给苏红共计2万元，要求苏红“多多照顾”。
春秋国旅公司一张姓副总经理亦送给苏红19万元，要求苏红在春秋航空公司上海至昆明航线、上海至北京航线及大陆至台湾的航空运输业务上帮忙。
立功退赃一审判8年罚百万
在法庭审理过程中，被告人苏红辩称，林某为其支付水星园房屋180余万元购房款，她把自己水碓子房屋的房产证交给林伟，给林伟写了借条，之后偿还了林某30万元，该笔经济往来属于借款性质。苏红的辩护人表示，苏红与林某之间的经济往来，与职务没有关联性，林某借钱给苏红买房，属于民间借贷，不应认定为犯罪。
对此，法院经查，林某出资184万余元为苏红支付购房款，苏红曾表示将自己的房屋送给林某，并于2006年归还给林伟30万元。2010年左右，林伟将房产证退还给苏红。从2005年至案发长达10余年的时间中，苏红既没有将自己的房屋实际交付给林某，亦在有能力还款的情况下，没有归还余款。
苏红利用职务便利将航线航班评审结果信息提供给林某，为林某谋取了利益，以借为名收受林某钱款，符合受贿罪权钱交易的本质特征。故苏红的行为非民间借贷，而属于受贿的性质。
而对于苏红收受加油卡符合拜年习俗，不应计入犯罪金额的辩护意见。经查，中国民航局对吉祥航空公司有行政管理关系，吉祥航空公司工作人员张某负责航线申报、航班计划申请、临时航班增补等业务。根据中国最高人民法院、中国最高人民检察院《关于办理贪污贿赂刑事案件适用法律若干问题的解释》第十三条第二款之规定，国家工作人员索取、收受具有上下级关系的下属或者具有行政管理关系的被管理人员的财物价值3万元以上，可能影响职权行使的，视为承诺为他人谋取利益。苏红收受张某给予的价值4万元的加油储值卡，属受贿性质。
法院认为，苏红的行为已构成受贿罪。鉴于其被调查后，主动交代了办案机关不掌握的其他受贿犯罪事实，积极全部退赃，有悔罪表现，且检举揭发他人犯罪，经查属实，有立功表现，依法对其减轻处罚。
二中院一审以受贿罪判处苏红有期徒刑8年，并处罚金100万元。在案扣押519万余元作为违法所得已没收，上缴国库。
