该胶囊的广告铺天盖地，不仅在美国各大电视台上播放，还在多家主流网站上轮番刊登，虚假夸大宣传了该胶囊的作用，误导消费者。纽约州总检察长埃里克·施奈德曼（Eric Schneidermant）抨击该胶囊“以弱势群体作为欺诈对象，利用了上了年纪的人们对于记忆力衰退的恐惧进行欺骗。”
