  经上海市青浦区检察院提起公诉,法院近日对上海焦耳蜡业有限公司(下称“焦耳公司”)实际控制人、高校教师张某作出一审判决,以危险物品肇事罪判处其有期徒刑二年,缓刑三年。


  2016年5月23日,位于上海市青浦区的焦耳公司发生爆炸,导致上海某高校化学系研究生李某以及两名该公司工人当场死亡。


  实验过程中突发爆炸


  2007年4月,上海某高校能源化工系教师张某设立了焦耳公司,经营助剂蜡等业务。张某担任公司法定代表人,全面负责公司的运营及实验指导工作。


  被害人李某系张某的学生,在读硕士研究生二年级。为完成硕士毕业论文,李某在学校实验室进行了多次小剂量的硝酸钠与硫氰酸钠混合加热实验。为进一步深化研究成果,张某与李某商量做大剂量的放大实验,并决定实验在焦耳公司进行。


  按照规定,硝酸钠禁止销售给个人,张某于是给李某提供经费以及焦耳公司的营业执照等证件,在网上购买了50公斤硝酸钠,并快递到焦耳公司。


  2016年5月23日,张某驾车载李某等人,将两包共计50公斤的硫氰酸钠运至焦耳公司,安排公司工人协助李某进行硝酸钠与硫氰酸钠混合加热放大试验。实验开始不久,张某因有事离开公司。


  当日15时许,李某与焦耳公司工人朱某、杨某在进行混合加热放大试验时发生爆炸,3人当场死亡。事故发生后,张某主动投案。公安机关立案侦查期间,青浦区检察院提前介入,引导取证,调查事故原因,并多次参加案件分析会议。


  经鉴定,爆炸事故系实验人员违规操作造成。专家分析指出,硝酸钠与硫氰酸钠均为禁配物,两者混合后具有爆炸倾向,实验室在试制前未进行任何反应危险性辨识及相关评估工作;在实际试制过程中,又采用了电热板直接加热的方式。此外,由于李某等人没有进行恰当的温度监控,仅采用了间歇式人工搅拌方式调控温度,导致搅拌不均,再加上物料量较大,传热效果不佳,使物料局部温度远超物料放热反应的起始温度,由此触发物料剧烈反应导致爆炸


  实验依据从资料中获得


  2016年12月22日,青浦区检察院以涉嫌危险物品肇事罪对张某提起公诉。


  当检察官问及张某是否知道大剂量硝酸钠与硫氰酸钠混合会引发爆炸时,张某称,自己没有搞过这类实验,是从一份学术资料中得知二者可以混合,于是指导李某做放大实验,没有想到会发生爆炸。而购买和贮存易爆品也没有申请批准和报备。


  学生为何在导师经营的公司做放大实验而不是在学校实验室进行?张某称,学校的实验室条件有限,材料不齐全,而且审批程序比较麻烦,该实验不一定能得到学校批准。为了图省事,与李某商量后就到焦耳公司进行了实验。李某不经常到公司去,对公司设备也不是太熟悉。


  疏忽大意未能预见后果


  检察官发表公诉意见指出,被告人张某身为化工系副教授,应当预见到大剂量硝酸钠与硫氰酸钠混合可能引发爆炸,但由于疏忽大意没有预见,主观上存在过失;张某帮助学生购买和贮存易爆品,违反实验操作流程,客观上实施了犯罪行为,且造成了3人死亡的严重后果,应当以危险物品肇事罪定罪处罚。鉴于张某具有自首情节且已与被害人家属达成民事赔偿协议,建议对其判处三年以下有期徒刑。


  辩护人提出,张某指导学生实验的目的是为了研究治理雾霾的良方,对改善大气环境具有一定作用,为了学术发展,建议法院对其免予处罚。


  法院审理后认为,张某违反爆炸性物品的管理规定,在使用中发生重大事故,造成3人死亡的严重后果,其行为已构成危险物品肇事罪,依法应予惩处。张某犯罪后自动投案,并如实供述罪行,系自首,且案发后对3名被害人亲属及因爆炸事故造成房屋受损的居民进行了经济赔偿并取得谅解。鉴于此,法院作出了上述判决。
