经审理，昌平法院认为，被告人徐某以非法占有为目的，采用秘密手段窃取他人财物，数额较大，其行为已构成盗窃罪，依法应予惩处。被告人徐某曾因故意犯罪被判处有期徒刑，系累犯，依法应当从重处罚。鉴于被告人徐某到案后如实供述犯罪事实，当庭自愿认罪，已赔偿被害人损失，取得被害人谅解，依法予以从轻处罚，判处徐某有期徒刑9个月，并处罚金1000元。
