那么，这个传销“帝国”是如何建立起来的？为何这么多投资者踊跃加入？而这个传销“帝国”又是如何覆灭的？近日，《法制日报》记者深入云南省曲靖市麒麟区人民检察院，揭开了“科勒民族资产计划”组织领导传销活动的黑幕。
编谎言：海外五老“送水上山”
利用“百度”搜索引擎输入“海外五老送水上山计划”，“百度”能为你找到相关结果72个。随便点开一个链接，就可以看到关于“海外五老送水上山计划”的相关内容。
所谓“海外五老送水上山计划”，民间流传多个版本，但大体内容都是讲在国民党从大陆撤离时期，有大批的资金留在大陆无法带走，为此，国民党安排了一批特工看守。随着时间的流逝，这批看守特工中的5个人将看守的资产转移到了英国，并在英国投资创业形成巨额财富。目前有8000亿兆英镑，现在生意做大，这批特工想要回报国家，于是拿出6000万亿英镑采取蚂蚁搬家福利发放的形式发给中国的穷苦老百姓。
具体的资金领取方式为，通过互联网站注册成为会员，并交纳会费900元、4500元和9900元，根据交纳现金的不同分别成为初级、中级、高级会员，每天领取不同金额的返利。
分层级：提成引诱编织传销网络
“海外五老送水上山计划”利用互联网站发展会员，网站会员分为三个等级，初级会员交900元，每天返利16元，中级会员交4500元，每天返利100元，高级会员交9900元每天返利220元，网站每天将会员的收益以现金币、种子币、股权币、公排币的形式发放到会员账户。
但是，按照规定，每天的返利只有52%可以兑换为现金币，另外48%作为通兑保证，分别是种子币8%、公排币12%、股权币18%和管理费10%。会员可用现金币向网站申请提现，一个币为10元人民币，每日提取现金不超过30个现金币。现金币可以转换为报单币，报单币用于注册新会员，向新会员收取入会费，不受兑换比例限制，会员名下开设六个账户或推荐六个会员加入，即可成立报单中心，用于注册新会员，相应的兑换比例由30%提高到85%。会员的收益除每天日分红，还有推荐奖、对碰奖、见点奖、领导奖等发展会员形成的间接收益。
该案主办检察官向记者介绍，一个会员推荐他人入会，即可获得被推荐人所交会费的14%，被推荐的人会被系统公排到推荐人的体系下面(按对碰奖的体系从左向右补空)。对碰奖的体系是按2的(N-1)次方向下排列(1层就是本人，2层就是两个人，3层是4人，依次类推)，在这个体系里的人可以由上级直接发展，也可以由系统自动公排，不管何种形式加入体系的会员，都会产生相应的奖，对碰体系以每个节点的人为参照，只要自己的体系向下每层满组1、2、4、16人，就产生对碰奖，用本人体系下面左边体系成员的注册金额和右边体系对碰，多减少，有余额的向下移一层。
网站通过这样的形式让参与者误以为通过低成本的投资能够在短时间内赚得更多的利润，从而实现“短、平、快”式的暴富。
据麒麟区检察院办案检察官介绍：“其实，这个网站是以中央特批福利发放、市场开发、分红等名目诱骗群众，本质是以传销手段鼓励会员发展下线，实现‘滚雪球’式的发展，并通过收取入会费谋取暴利。”
现原形：网站突然关闭不能提现
2015年9月21日，网站对外发布公告，宣称由于网站中病毒，所有会员均不能提现，必须等待系统恢复正常。
长达两个月的等待后，2015年11月30日，一个全新的网站出现在会员面前。此时，该网站管理人员对外发布通知，所有会员要想在2016年1月1日顺利兑到钱，必须到新网站重新注册，注册成为新会员需要大量的报单币，报单币只能找网站管理员购买。
此时，新旧网站的更替非常混乱，很多会员开始有所怀疑和动摇。为了稳定军心，曲靖地区的李小粉组织了一个“千人大会”，邀请“大哥”许家海为大家讲解新老系统的对接问题。也正是这个“千人大会”，将这一网络传销团伙引入曲靖警方的视线，一个传销“帝国”浮出水面。
原来，所有人深信不疑的“海外五老发钱计划”会员发展网站，实际上是湖南人上官斌出巨资从他人处购买，并安排专业软件制作人制作的网络传销系统，其前身为“CC互联网理财会员管理系统”。
上官斌安排软件制作人将系统更名为“科勒民族资产”(会员业绩管理系统)，并要求加入者提供手机号码注册。会员业绩管理系统自2014年11月开始运行，运行至2015年10月，因为老会员发展新会员的速度开始缓慢，跟不上网站系统分红的速度，老会员分红得来的电子币无法兑换现金，便纷纷找上线询问原因。上官斌为了维护网站的运营，即编造出网站中病毒的谎言。上官斌不甘心将原来收取的会费返现给会员，于是将会员业绩查询管理系统关闭，重新开发一个“科勒资本会员管理系统”，并于2015年11月开始运行。
上官斌于2014年介绍许家海加入科勒民族资本，是许家海的直接推荐人，在该体系中处于金字塔尖位置。“大哥”许家海则是该计划在云贵川三省的总负责人，多次进行公开宣传，发展会员，形成层级关系和金字塔获利结构。“科勒民族资产计划”直接或间接以发展人员数量和层级作为返利依据。至2016年1月，该网站涉及省份共发展会员17501人，获取会员注册费3000余万元，涉及除香港、澳门、台湾外的中国大陆地区23个省、5个自治区、4个直辖市。
该案经麒麟区检察院提起公诉，法院审理后认为，被告人上官斌、许家海犯组织、领导传销活动罪，判处上官斌有期徒刑6年，并处罚金人民币5万元；判处许家海有期徒刑5年零6个月，并处人民币罚金4万元。
