北京市盈科(深圳)律师事务所陈翰笙律师表示,海外淘宝过程中转运公司的义务多为代收转寄,如果货物在转运公司交付消费者过程中丢失,消费者有权要求转运公司按约赔偿。同时,如果货物是国内第三方物流公司丢失的,则消费者除有权要求转运公司理赔外,根据快递服务合同的特性,消费者也有权直接要求国内第三方物流公司赔偿。无论先锋快递还是天津邮政,二者都侵犯了张女士的正当权益,张女士有权要求进行赔偿。
