太康县华夏外国语小学大肆租用农民土地，开发商品房和独院别墅，“学生报名处”成了“售楼部”。对此，当地多部门称执法困难，前往执法时曾两次遭遇校园人员围攻。
[举报]小学校园建别墅公开售卖
近日，东方今报接到读者投诉，称太康县华夏外国语小学租用农民土地建学校的同时，还在校园违规建设独栋带院别墅及多排小高层商品房对外公然销售。别墅建设一年多来，不但没有被查处，而且房子越建越多，一直没有人管。
[调查]“学生报名处”兼“售楼部”
针对举报，2月9日上午，记者来到位于太康县阳夏路北段的华夏外国语小学走访调查。记者进入校园内看到，南侧一排高11层楼房，该楼共有6个单元。校园内西侧有两排共十栋独院别墅，别墅高三层半，再往里走是三排高7层共12个单元的电梯楼房，均已完工。
随后，记者以购房者的名义询问校内老师和保安后，得到一致的回答：要买房得去“学生报名处”，“学生报名处”就是“售楼部”。
在该校“学生报名处”，记者看到房门边不但贴有“学生报名处”字样，还有未撕干净的“售楼部”标志和完整的“物业电话”字样。
走进该办公室，一名女老师一边给学生家长办理学生业务，一边给记者讲解校内楼房的优势和配套资源，该老师称：“校内南侧一排6个单元的房子早就卖完了，西侧三排7层12个单元的楼房卖得只剩下个别5、6、7层的几套了，户型有三室一厅和三室两厅，面积都是132平方米一套，2楼至7楼的房子2000元一平方米，1楼的是2750元一平方米，因为1楼带个小院子所以贵些，没动工时一楼的房子就卖完了，那两排独门独院别墅也早已售罄。”
当问到该房产能否办理房产证时，该女老师说：“你们选好房子，一星期内把房子全款交过来，我们给你开票据，签订完购房合同，到时候可以集体办理房产证，想买就抓紧时间。”
[质疑]土地部门涉嫌以罚代管
学校内公然建设房屋对外销售，而且还建设别墅，这明显是违反国家相关法律的，当地相关执法部门对此事又是如何监管的？
当日下午，记者来到太康国土局了解情况。该局监察队员告诉记者，华夏外国语小学是2005年开始建设的，当时当地审批了83.7亩作为教育用地，用作建设该学校，这些土地都是租用毛庄镇大刘庄行政村的耕地，租期为15年，租金为每亩每年1000元。
当时，华夏外国语小学只是拉起了围墙圈了20余亩地。2010年9月份，太康县清理清查违法违规用地规范用地秩序指挥部查处了该校非法占用土地，对其下达责令停止国土资源违法行为通知书，并对该校违法违规行为进行行政处罚：1。没收在非法占用工地上新建的建筑物和其他设施。2。对非法占用14988.3平方米的土地以每平方米15元罚款，计款224824.5元。
2011年1月，该校缴纳了250万元的部分土地出让金，之后此事搁浅。随后，华夏外国语小学在教育用地的校园内建起了独门独院别墅和几十个单元的小高层楼房对外公然出售。
[回应]住建部门：查处时曾遭围堵
一栋房屋的建设不但要有合法的土地手续，还需要规划、住建和房管等部门的批准。其他部门对此又是如何执法的呢？
据了解，太康县规划、住建和房管均为该县住房城乡建设局主管。当日，记者到该局监察大队了解情况。
谈到华夏外国语小学的违建时，该局办公室人员告诉记者，对于该校校园内违法建筑，他们也有一肚子苦水：“提起华夏外国语小学的第一反应就是极其尴尬。”
该工作人员介绍说，监察队多次对该校进行停工执法，而且不止一次遭到阻挠。
住建局监察队给记者出具了一份《关于查处华夏小学院内违章建筑遭学校教师煽动学生围堵执法队员的情况说明》。该情况说明描述了执法队员遭遇学校人员阻挠的情形。
该说明显示：2016年8月30日上午，对华夏外国语小学在学校院内私自搭建构筑物，监察大队与多部门进行联合执法，执法队员到达现场后发现该违法建筑正在施工，对其施工人员出示执法证件并责令其停止施工，施工人员不顾执法队员的阻止继续施工，执法队员阻止无果后按规定暂扣其施工机具。随后，该校负责人带领学校工作人员到施工现场要求执法队员归还被暂扣的施工机具，并安排学校教师煽动现场围观学生阻挠、围堵执法队员，让门卫关闭大门，不让执法车辆离开，更有教师煽动学生爬上执法车抢夺被暂扣的施工机具，鼓动学生辱骂执法队员，用石子、碎砖块投掷执法队员和车辆。
执法队员与学校负责人交涉无果后报警，后在民警帮助下离开学校。在学校门外等待民警时，学校教师组织带领学生继续围堵执法队员，毛庄镇派出所民警到达现场与学校负责人调解无果后，为避免发生群体性事件，无奈之下执法队员只能将执法车辆丢弃在校园内步行离开现场。
学校老师煽动多名学生对执法队员进行对抗，并围困执法人员和执法车辆。执法部门只得报警求助，后经警察调解，执法队员才能离开现场，而装着暂扣施工机具的执法车辆却被困在校园内，之后该校对执法部门下达的停工通知置若罔闻，继续施工直到楼房完工。
[回应]太康副县长：还不了解情况
学校对执法部门的执法为何会是对抗？该学校有何背景？各部门难道对该校的违规行为毫无办法？昨日下午，记者电话采访了太康县分管国土、住建的副县长李明朗。李明朗称他还不了解这个情况，等了解具体情况后再向记者反馈。
对于此事，记者多次电话联系太康县教体局宋局长。宋局长均以正在开会为由，挂断了电话。
