中海油原副总经理获刑 伙同妻子受贿180余万
中国海洋石油总公司原副总经理吴振芳，利用职务便利为他人提供帮助，伙同妻子张某共同收受他人给付的房屋装修款170万元。此外，吴振芳还收受他人为其本人及亲友支付的机票款共16万余元。北京晨报记者昨天获悉，近日东城法院以受贿罪，一审判处吴振芳有期徒刑3年6个月，其妻张某同样因受贿罪，被判处有期徒刑3年，缓刑3年。
退休两年后被调查
公开资料显示，1952年1月出生的吴振芳，曾任中国海洋石油南海西部公司副总经理，香港近海石油服务公司董事等职。1997年至2003年任中海石油化学有限公司总经理兼党委书记。2003年4月任中国海洋石油总公司总经理助理，2003年6月兼中海石油化学有限公司董事长和中海石油天然气及发电有限责任公司董事长。2004年9月任中国海洋石油总公司副总经理、党组成员。
2015年年初，中央巡视组启动首轮针对26家央企的专项巡视，13个巡视组进驻中石油、中海油、国家电网等单位。同年3月初，中央第二巡视组进驻中海油总公司，随后吴振芳就被调查，此时他已退休两年。2015年6月25日，中国最高人民检察院通报吴振芳因涉嫌受贿被立案侦查。
帮助收购公司受贿180余万
据检察机关指控，2008年至2009年间，吴振芳利用职务便利，为中海油收购王某实际控制的化学公司提供帮助。2012年至2013年间，吴振芳伙同妻子张某共同收受王某给付的房屋装修款共170万元。此外在2010年至2014年间，吴振芳还收受王某为其本人及亲友支付的机票款共16万余元。
在本案庭审中，吴振芳对指控事实及罪名均提出异议，辩称未给王某谋利，对于16万多元的机票钱其也认为是礼尚往来，并非是受贿之举。
而王某作证称，他于2001年成立了一家石化公司。2004年他与中海油合作，将石化公司改制为合资企业，自己任副董事长和总经理。2006年吴振芳开始兼任中海石油炼化公司总经理，由此结识了吴振芳。2008年，王某成立了另一家化学公司，但不久资产缩水，濒临破产。为此他去求吴振芳帮忙，希望中海油能够收购化学公司。王某称，正是因为吴振芳是中海油的领导，有很大决定权。之后在吴振芳的大力支持和推进下，王某的化学公司果然与中海油重组，成为合资公司。在被中海油收购后，原本境况不佳的化学公司经营状况好转，银行也给公司的贷款降了息，公司由负债变成盈利。
2012年的一天，在得知吴振芳在上海有一套房子正准备装修时，王某便给吴家装修一共支付了170万元。而吴振芳在得知此事后，也未提出还钱，表示默认。
构成受贿罪夫妻均被判刑
东城法院经审理认为，吴振芳及妻子张某均已构成受贿罪，公诉机关对二人的指控成立。对于吴的辩解，法院认为在收购化学公司过程中，吴振芳利用职务便利，接受王某请托为王某公司谋取利益。王某在支付装修款后，吴振芳夫妻在有能力支付装修款的情况下，并未及时退还该款项，其行为属于受贿。
此外，吴振芳作为国企的领导干部，在明知给付方为其支付机票款主观目的的情况下，仍连续多年收受王某为其本人及亲友支付的机票款，该行为与吴振芳的职务行为存在紧密关联，明显不属正常的人情往来，应认定为受贿。
鉴于吴振芳已退缴全部违法所得，并预缴罚金，依法可对其从轻处罚。张某能如实供述，也已退缴全部违法所得，并预缴罚金，也可对其从轻处罚并宣告缓刑。
综上，东城法院一审以受贿罪，判处吴振芳有期徒刑3年6个月，并处罚金20万元；以受贿罪，判处张某有期徒刑3年，缓刑3年，并处罚金20万元。
