近日，宁夏回族自治区吴忠市中级人民法院对银川市原党委常委夏夕云受贿案作出一审判决，被告人夏夕云犯受贿罪，判处有期徒刑13年，并处罚金400万元。其随案移送的财产上缴国库，予以没收，对剩余的194万元继续追缴。
经法院审理查明，夏夕云自2005年至2013年期间，在担任石嘴山市交通局局长、永宁县县委书记、永宁县望远工业园党工委书记、银川市经济技术开发区党 工委副书记、银川市金凤区区委书记、银川市阅海湾中央商务区管理委员会主任、银川市党委常委期间，利用职务之便，为他人谋取利益，34次非法收受16个单 位或个人财物，共计价值2215万余元，数额特别巨大，其行为构成受贿罪。
个体老板如同提款机
经法院审理查明，2005年至2013年期间，夏夕云34次非法收受16个单位或个人财物，共计价值2215万多元，而这8年间，夏夕云要么是县区党政“一把手”，要么是主管政府工程的主要负责人，位高而权重，极易发生贪腐。

经法院审理查明，2012年5月，时任银川阅海湾中央商务区管理委员会主任的夏夕云主动给江苏省沭阳县绿苑花卉园艺有限公司银川分公司中阿之轴项目代理人 马某打电话，声称想给父母在银川买一套房子，问马某有没有好房源。马某陆续给夏夕云选了几套房，但夏夕云都觉得不合适，最后告诉马某他看上了一套房，但手 头比较紧，问马某能不能给拿点钱。马某一听，立刻奉上100万元购房款，让夏夕云自己操作买房事宜。
马某向检察机关供述，之所以及时送上购房款，是因为夏夕云当时主管工程建设这一块，他的公司刚中标中阿之轴景观工程，夏夕云在工程款的拨付上有着决定权。
2012年7月，夏夕云再次给马某打电话，声称其儿子快毕业了，想开办一家工程咨询公司，马某就给夏夕云详细讲解了开办咨询公司所需场地、经费等问题。过 了几天，马某为拨付工程款的事找到夏夕云，夏夕云的态度非常不好，并敲打马某说其儿子开办公司的事情马某没有尽心给办。于是马某又找到银川分公司负责人， 共同商量拿出50万元，作为夏夕云儿子开公司的启动费用。
有了两次成功的运作，马某所在的公司将工程进度上报后，夏夕云都能及时签字将工程款拨付。
收受情人房屋致案发
一边收受贿赂，一边一路升迁，8年的贪腐生涯，夏夕云自以为可以瞒天过海。
在法庭庭审中，检察机关出示的夏夕云涉嫌受贿案侦破经过的有关证据显示，2015年4月，宁夏回族自治区纪检委对夏夕云违纪线索初查，发现夏夕云利用职务之便，为他人谋取利益，收受其情人苏姗位于银川市兴庆府大院小区住房一套、现金180万元、英镑20万元。
2015年4月17日，宁夏纪检委报宁夏回族自治区党委后立案调查，并通知夏夕云当日到指定地点对以上问题作出解释和说明。夏夕云当日主动交代接受苏姗房 屋一套，还主动交代多次收受他人现金1027万元的不法事实。2015年7月，宁夏回族自治区人民检察院对夏夕云一案立案侦查。
经法院审理查明，2009年，苏姗成立了宁夏华夏置业有限公司，并出任公司法定代表人、董事长。依托她与夏夕云的关系，苏姗的公司从2009年至2011 年，顺利承揽了永宁县医院扩建工程、银川市金凤区高桥安置区代建工程、银川市阅海中央商务区环二路工程。在工程招标过程中，夏夕云给相关主管部门都打过招 呼。
2010年8月，夏夕云想给父母在银川买一套住房，苏姗为了感谢夏夕云多年来的支持，便出资在银川市兴庆府大院买了一套房，装修好后送给夏夕云，后夏夕云以90余万元转手将房屋转卖给他人。
为了掩盖收受苏姗房屋的事实，夏夕云让苏姗与买房人补签了房屋买卖协议，以造成这套房屋是苏姗卖给买房人的假相。
千万赃款家人帮打理
经法院审理查明，2009年至2012年期间，夏夕云共给其妻弟刘某某1300万元现金让其保管，刘某某拿着这些钱用于做生意，其中一部分投资建设彦翔工贸公司。
2010年至2014年期间，夏夕云还找到其妹夫田某某，给了400万元让其办理存款，田某某以夏夕云的堂弟名义开办了银行卡。同时，田某某还替夏夕云保管过345万元，以他人名义购买了理财产品。
2014年10月至2015年4月，夏夕云感觉事态不妙，便吩咐其妻弟拿出730万元，自己拿出现金194万元和家里的外币折合人民币186万元，给7名行贿人退赃。
夏夕云受贿案立案侦查后，涉案的8个行贿单位或个人被立案处理。
另据法院查实，2015年8月，夏夕云在接受调查期间，检举银川市西夏区区委原副书记、区长李维国伙同他人收受贿赂的线索。经初查，检举情况基本属实。 2016年1月，李维国涉嫌受贿一案被立案侦查。2016年11月10日，李维国受贿案、高利转贷案在石嘴山市中级人民法院一审开庭。
法院审理后认为，被告人夏夕云能主动、如实交代办案机关尚未掌握的绝大部分受贿事实，对证据的收集具有重要作用，具有坦白情节，可从轻处罚。夏夕云检举揭 发他人的不法行为，经查证属实，系立功，可从轻处罚。夏夕云在案发前给部分行贿人退赃共计1250万余元，属积极退赃。同时，夏夕云案发后能真诚悔罪，主 动交代赃款的动向及保管人，对追缴赃款提供帮助，可从轻处罚。辩护人提出被告人夏夕云具有立功、主动退赃，认罪、悔罪，请求从轻处罚的辩护意见成立，予以 采纳。法院遂作出上述判决。
