　　案情回放：政府投资煤矿发生瓦斯爆炸

　　2017年2月14日凌晨，一声爆炸，自湖南省涟源市东部的斗笠山镇响起。

　　从娄底市新闻办获悉，2月14日凌晨1时37分左右，位于涟源市斗笠山镇的祖保煤矿发生瓦斯爆炸。事发时，共有29人下井，其中17人上井，12人被困井下，当日被困人员中，有1人获救。截至14日下午，已发现8具遇难者遗体，尚有3人下落不明。

　　最新进展：三名官员因瞒报被立案调查

　　事发一天后，2月15日，多家媒体播发消息称，涟源祖保煤矿爆炸事故共造成9人死亡，3人受伤，无生命危险。事发煤矿为股份制企业，证照齐全。此外，事发地斗笠山镇多名党政官员被问责，镇党委书记及镇长被免职。

　　事故余波未消。昨日上午，娄底市政府新闻办通报称，2月16日，娄底市在祖保煤矿瓦斯爆炸事故救援处置过程中，发现1名伤者身份存疑。娄底市委、市政府即成立专案组展开调查。经核实，祖保煤矿采用冒名顶替方式，瞒报1名遇难人员，实际遇难人数10人。

　　记者从一名接近娄底市委的人士处获悉，娄底市委于2月17日晚召开紧急会议，决定对负有责任的涟源市委常委、常务副市长梁小兵，涟源市政府副市长谭付民和负责事故下井人员人数核对工作的涟源市安监局局长肖笑华立案调查。目前，娄底警方已对组织或参与冒名顶替遇难矿工事件的祖保煤矿多名工作人员采取刑事强制性措施。

　　今日，涟源市纪委书记孙纬辉向记者证实，事故发生后，娄底市组成专案组，对遇难人数进行核查，“一个一个的对”，最终确认瞒报事实。目前，案件由湖南省和娄底市两级纪委牵头。

　　解读一：瞒报对官员们有啥好处？

　　事发3天时间，湖南涟源包括两名副市长在内的3名官员被追责。当地政府为何要将10名遇难者瞒报为9人？国家行政学院教授汪玉凯分析，涟源市部分官员的行为动机，与当前生产安全事故的分级标准相关。

　　记者注意到，在由中国国务院颁发，2007年6月1日起施行的《生产安全事故报告和调查处理条例》中，将生产安全事故依据人员伤亡或财产损失，分为一般、较大、重大和特别重大四级。其中，认定“较大事故”与“重大事故”的分界点，即为死亡人数10人。

　　根据这一分级规定，造成10人以上（含）30人以下死亡者，将被定义为“重大事故”。汪玉凯介绍，事故分级不同，处置单位级别乃至问责范围都会相应变化。

　　在汪玉凯看来，“瞒报”与部分基层政府畸形的政绩观密切相关。他表示，基层官员在升迁时，往往会面临重大安全突发事故“一票否决”的情况，在这种压力下，为了防止影响升迁，部分地方官员本着侥幸心理，希望“大事化小、小事化了”，将事故影响“往下压”。

　　解读二：为何对这仨官员立案调查？

　　记者检索发现，在《中华人民共和国突发事件应对法》中，将突发安全事故的监测、处置责任主体，定义为“县级”。汪玉凯称，这一法律定义，正是此次事件中，处置涟源市涉事官员的依据。

　　《中华人民共和国突发事件应对法》第三十九条规定，有关单位和人员报送、报告突发事件信息，应当做到“及时、客观、真实，不得迟报、谎报、瞒报、漏报。”其第六十三条则进一步阐释为，“迟报、谎报、瞒报、漏报有关突发事件的信息”，根据情节，将对直接负责的主管人员和其他直接责任人员依法给予处分。

　　此外，《中国国务院办公厅关于严肃查处瞒报事故行为，坚决遏制特重大事故发生的通报》，明确要求“任何单位和个人对事故不得迟报、漏报、谎报或者瞒报”。国家监察部等六部门联合颁发的《监察部中国公安部司法部安全监管总局中国最高人民法院中国最高人民检察院关于严肃查处瞒报生产安全事故行为的通知》，则进一步强调要“加大对瞒报事故行为的查处力度，依法严惩瞒报事故责任人”。

　　此前，北京市中国最高人民法院法官、行政法专家李洋曾表示，对于谎报、瞒报领导干部的追责，除了按相关法规追究法律责任外，还要进行党内问责。《关于实行党政领导干部问责的暂行规定》中提到，对突发性事件“弄虚作假、隐瞒事实真相”，要加重问责。
