　　这已不是山寨网站第一次出现。随着互联网的发展，各种山寨网站层出不穷，尽管相关部门在不断打击，但山寨网站依然呈现不绝之势。《法制日报》记者采访发现，山寨网站屡打不绝的原因，还是利益驱动。

　　山寨网站类型不少

　　中国互联网信用研究院院长、盘石股份董事长兼CEO田宁告诉《法制日报》记者，随着国内互联网不断发展，产业形态极尽丰富，如今不只是在PC端，甚至在移动APP端都出现了山寨网站和山寨APP，一个个网络陷阱层出不穷，让人防不胜防，这些非法网站极大地损害了网民利益，也影响了互联网产业健康发展。

　　去年年底，一位知名媒体人在其微信公号发布消息，揭露了六家山寨网站，引起社会热议。

　　据了解，与冒充三甲医院官网不同的是，上述六家山寨网站冒充的都是知名新闻网站。

　　田宁把山寨网站划分为以下几种类型：

　　最常见的山寨网站，就是完全模仿域名和页面，例如：淘宝网的域名是www.taobao.com，山寨版则是www.taobao.net.com，同时网站页面的设计风格也一致。开设此类山寨网站的不法分子往往在海外注册，使用海外服务器。如果消费者不注意，就会上当受骗。

　　第二类山寨网站的特点是模仿权威，比如带有“中国”“国家”“北京”等字眼。比如，不法分子开设一个与国家某部委网站很相似的网站，自己取名“中国国家某某部门”（实际没有该部门），以国家名义套取消费者信息，使消费者权益受到损失。

　　还有一类山寨网站则是抄袭某官方网站的内容，称以低廉价格售卖同样产品，吸引消费者，实质上以各种名义套取客户信息或财产，导致消费者受到经济损失。

　　中国政法大学知识产权中心特约研究员、中国互联网协会信用评价中心法律顾问赵占领认为，山寨网站通常的特点就是使用与官方网站非常接近、非常相似的域名，网站页面与官方网站页面相比也基本相同或者非常接近。“页面相同容易做到，但是域名本身具有唯一性，山寨网站只能采取一个相似域名，不可能完全相同。相似的域名就能带来很多用户。现在大家都不擅长记域名，尤其是比较长的域名，更不会去记，上网时就凭一个大概印象。在这种情况下，用户就容易进入山寨网站，然后上当受骗”。

　　“用户为什么会访问山寨网站？这与很多因素有关。或者说，山寨网站让用户上当受骗的渠道有多种。比如，以伪基站的名义发送一个短信，或者假冒银行发送短信，内容通常是进行促销活动，像积分兑换奖品、中奖之类，然后诱使用户点击链接了解详细情况，用户点击进去的，就是山寨网站、钓鱼网站，这是一种渠道。这种方式隐蔽性比较强。还有一种比较常见的渠道是，用户在购物过程中给收到的某个网址付款，实际上是山寨网站，当用户支付时，相关信息就被盗取了。”赵占领说。

　　对于山寨网站的危害，田宁概括为四点：用户个人信息泄露，威胁财产安全；损害原版网站声誉，导致企业与用户之间的信任崩塌；阻碍互联网良性发展，导致信用危机；扰乱正常的市场经济秩序。

　　层出不穷原因何在

　　据田宁介绍，2016年，在第三届世界互联网大会召开期间，北京盘石信用管理有限公司联合中国电子商务信用认证平台、中国互联网信用研究院在乌镇互联网国际中心发布厅发布《2015-2016中国互联网信用报告》。

　　根据报告提供的数据，2015年中国境内仿冒网站页面数量达18万余个，较2014年增长85.7%；网站被篡改数量达近2.5万个，较2014年减少49.1%。

　　田宁认为，PC互联网已日趋饱和，移动互联网却呈现井喷式发展。因此，山寨APP和恶意程序也不断出现。春节拜年本是最正常不过的事情，然而这也成了不法分子眼中行骗的好机会。例如，不法分子在过年期间发送视频内容“我给你录了段录像你看看”“给你拜年了！点击查看视频”等，在今年春节前后，就有不少人收到这样的疑似信息，一旦点击，便会进入钓鱼网站，面临个人信息与账号密码被盗风险。

　　山寨网站为何层出不穷？田宁认为，其直接原因就是利益驱动。不法分子利用极低的成本，仿冒真实网站的网址以及页面内容，得到较高回报。在高额利润诱惑下，不法分子屡屡制造各式各样的山寨网站。这些山寨网站和山寨APP或仿冒成政府部门、银行等网站获得用户信任，或通过利诱致使用户上当，从而骗取用户银行或信用卡账号、密码等私人资料，或欺骗用户直接将钱打入不法分子的账户，为“黑客”、不法网站带来丰厚的经济利益。

　　“除此之外，网络监管不到位、技术上存在难度以及用户自身缺乏安全防范意识等，也是造成山寨网站泛滥的重要原因。”田宁说。

　　赵占领认为，目前打击山寨网站还存在几个难点：首先，山寨网站违法成本很低。做一个网页只需半天或者一天的时间，执法部门今天封了网站，不法分子明天可以再换一个网站。其次，山寨网站可能采取一些规避措施隐藏经营者真实身份。比如，不法分子注册国际域名，不需要在国内备案就可以上线。用户查看时，很难查看其真实身份。另外，这种网站不容易被封掉，因为其服务器不在国内，域名也不是国内域名注册商所提供的域名。此外，山寨网站数量众多，使得监管执法成本较高。

　　如何追究法律责任

　　对于山寨产品来说，都绕不开知识产权保护问题，山寨网站也不例外。

　　中国社会科学院法学研究所研究员李顺德认为，山寨网站使用正规网站已经注册过的商标，包括模仿正规网站的名称、页面、具体设计布局等，都牵涉到知识产权方面的问题。如果山寨网站也开展相关经营活动，还可能涉及不正当竞争。

　　“追究山寨网站的法律责任要看具体情况。”李顺德说，原创网站为了维护自身合法权利，首先应该积极取证。由于网上证据变化比较快，也容易被删除，所以一般是事先通过公证处来取得有效的证据。

　　“搜集证据之后可以通过多种方式维权，比如说可以找相关行政管理部门投诉，寻求行政救济，还可以直接到法院提起诉讼。根据具体情况，主张维护自身权利。总之，原创网站要积极维权，不能纵容这种山寨网站的存在，山寨网站不仅损害原创网站合法权益，而且会给社会公众带来混淆和误导，甚至造成一些比较严重的后果。”李顺德说，对于山寨网站来说，如果造成比较严重的负面后果，不仅要承担民事责任、行政责任，如果构成刑事犯罪，还应该被追究刑事责任。

　　在日常生活中，人们该如何辨析山寨网站？

　　据田宁介绍，2009年，北京盘石开始承担中国电子商务信用认证平台的建设、管理及日常运营维护工作，开展实施中国互联网、电子商务行业信用评价工作，可以从以下几个方面认定正规网站：查看有无诚信网站标识；点击诚信网站看能否打开；诚信网站认证信息通过中国互联网络信息中心、国家互联网应急中心、国家工商行政管理总局、国家质量监督检验检疫总局、中国最高人民法院执行局、国家工信部电信管理局和中国公安部中国公民身份查询中心等七大部门数据的真实比对，可登录电子商务协会数字服务中心官网查验。

　　对于打击山寨钓鱼网站，赵占领认为目前还缺乏有效的机制，现在的主要进展是成立了中国反钓鱼网站联盟。

　　据了解，早在2008年7月18日，由国内银行证券机构、电子商务网站、域名注册管理机构、域名注册服务机构、专家学者组成的“中国反钓鱼网站联盟”就正式宣布成立，

　　“反钓鱼网站联盟主要是针对域名、注册商是国内的，但是对于国际域名，还需要加强与国际机构的合作，建立更加高效的打击机制。另外，也需要开展国际司法合作。”赵占领说。
