　　事件仍在调查中

　　2月6日，一条由名为＠Ah_cal的网民发布的微博引爆舆论圈，其内容称，自己在广西考察期间，受当地“李局长”、“黄书记”邀请，在其办公室吃了煮穿山甲，还表示“深深地爱上了这野味”。由于涉嫌食用濒危保护动物，并且与“局长”、“书记”等领导扯上关系，这则消息引发大量转载和评论。

　　广西壮族自治区纪委核查：2015年7月8日至10日，广西举办了“投资广西走向东盟——2015年香港企业广西行”活动。活动结束后，该考察团个别成员自行留在南宁，并参加了私人组织的宴请活动，活动地点在某私营企业内部饭堂。

　　珍稀野生动物案件频发

　　广东、广西两地被疑食用穿山甲事件引起舆论高度关注，折射出公众对珍稀野生动物保护现状的深深担忧。国际野生动物贸易研究组织报告显示，2007年至2016年，中国共查获209起穿山甲走私案件，涉案穿山甲12000多只。中国动物学会副秘书长张立说：“根据调研结果，2008年中国穿山甲数量约为两三万只，比2002年减少了一半，大约中国一半的省区已经绝迹。近十年来没有系统调查，但捕杀行为愈演愈烈，加上穿山甲野外繁殖缓慢，种群数量肯定下降了更多。”

　　不仅是穿山甲，娃娃鱼、猫豹等珍贵、濒危野生动物如今也成为餐桌上的“美味”。在暴利驱使下，不法分子铤而走险，非法走私、运输、贩卖珍稀野生动物案件近年来也屡有发生。

　　2016年，浦东机场旅客检疫部门截获穿山甲鳞片70批次，合计162.34公斤。专家粗略估算，按照一只穿山甲可取鳞片0.4公斤计算，这意味着约有406只穿山甲被捕杀。上海机场出入境检验检疫局有关负责人在接受媒体采访时表示，近年来，在来自非洲、中东等地区的“重点航班”中，经常会查出旅客携带穿山甲鳞片入境。

　　随着类似案件的不断曝光，舆论对于严厉打击非法买卖食用野生动物的呼声也越来越高。不少民众在论坛、微博等网络论坛上发表留言称，在食用野生保护动物行为的背后，一方面是一些人为了追求这些动物所谓的“医疗养生”等功效，另一方面则是带有炫耀成分的特权思想。有群众表示：“没有买卖就没有杀害，现在穿山甲大概要几千块钱一斤，高额的利润导致它们越来越濒危。”

　　《瞭望》新闻周刊记者在广西南宁市走访时，有受访群众也坦言：曾有过食用或药用穿山甲、猫头鹰等野生动物的经历，但随着观念的转变和保护意识的提高，不少人已经开始摒弃昔日“吃野味能养生、有面子”的想法。

　　与此同时，专家指出，频发的野生动物违法案件折射出加强野生动物保护的迫切性，也凸显出相关方面的管控难点。

　　针对非法捕猎野生动物的现象，中国人与生物圈国家委员会委员、沈阳理工大学副教授周海翔在受访时表示，野生动物捕猎行为非常隐蔽，很难被抓现行。同时，鸟网等捕猎工具的成本很低，被清理完后不法分子极易继续安装。

　　专家表示，一旦查获捕猎或贩卖国家重点保护野生动物案件，数量少的执法部门只能没收，只有数量非常大的才可能构成非法经营罪，但不法分子为躲避刑罚，经营数额很少达到入刑的标准。现有的法律法规处罚力度有限，无法有效威慑不法分子。此外，在利益的驱动下，一些不法分子为躲避监管，收购、销售等环节日趋隐蔽，有的只做熟人生意，给相关违法行为的查处带来一定困难。

　　亟须建立跨国保护协作机制

　　受访专家表示，近年野生动物违法犯罪活动呈现出网络化、国际化、高科技化等新特点和新趋势。一些基层执法人员和专家建议，加大打击力度，建立跨国保护协作机制，让野生保护动物捕猎、交易和消费无处遁形。

　　第一，尽快填补法律漏洞，加大处罚力度，震慑不法分子。周海翔认为，中国的野生动物保护法未把野生动物保护上升到整个生态安全层面，只注重保护处于生物塔塔尖的珍贵、濒危物种，对处于塔基和塔身的其他物种的保护不够。但只有塔基和塔身物种的数量够多，才能够养活塔尖的物种，维持整个生态系统的平衡，减少人们在农田、果园、草原、森林的农药使用量，这也是人类的生存之道。

　　广西民族大学法学院副院长杨红文教授说，中国刑法对非法猎捕、杀害、收购、运输、出售珍贵濒危野生动物有规定，而对持有行为却没有明确规定。她建议对非法持有、合法持有要有鉴别机制，若大量持有珍贵濒危野生动物制品，并说不清合法来源，可根据数量推断为非法持有，接受法律处罚。

　　周海翔建议，只要非法持有或食用国家重点保护动物，可以像毒品、枪支一样按照“持有即违法”的原则，交代不清上线可按盗猎处罚。

　　第二，尽快建立和完善跨国打击走私野生动物的协作机制。一些专家表示，由于东南亚国家对野生动物保护的种类标准与中国不同，中国公安、边防、检验检疫等部门应加快与东南亚国家之间的跨境协作，形成覆盖中国—东盟自贸区范围的协作沟通机制。

　　张立介绍说，“过去更多是从东南亚地区走私马来穿山甲，目前已发现有非洲、印度穿山甲甲片走私到中国，亟须加强国际范围内的打击走私力度，更好地保护珍稀野生动物。”

　　第三，加强科普和法制教育，引导全民参与保护。周海翔认为，近年中国民众野生动物保护意识不断提高，很多违法案件通过网络举报得到曝光和查处。应进一步加大野生动物保护科普力度、法治宣传，提高野生动物保护法的知晓度。

　　张立等专家表示，野生动物没有经过检验检疫且很多野生动物是被毒死的，随意食用存在致残、致死风险。应当通过一些措施对“吃野味对身体有大补”的错误观念和消费陋习进行纠正，加大市场监管力度，堵住保护野生动物各个环节链条的漏洞。
