记者获悉，广西高院终审以受贿罪、利用影响力受贿罪，判处罗卫国有期徒刑15年，并处没收个人财产200万元；以受贿罪、利用影响力受贿罪判处崔丽华有期徒刑10年，并处没收个人财产人民币10万元、罚金人民币10万元。

纪检组长退休后被抓情妇同落网

记者了解到，法院经审理查明，2005年至2011年3月，被告人罗卫国利用担任自治区国土资源厅党组成员、纪检组长职务上的便利，在承揽土地开发整理项目建设工程等事项上，为南宁某机电设备有限公司、来宾市某实业有限公司、陈某某、王某某、郑某等单位和个人提供帮助，单独收受上述单位和个人给予的财物437万余元，与被告人崔丽华共同收受郑某给予的财物270万元，共计人民币707万多元。
2011年3月至2013年，被告人罗卫国离职后，利用其原职权或地位形成的便利条件，通过下级单位国家工作人员职务上的行为，在承揽土地开发整理项目建设工程等事项上，为李某某、郑某谋取不正当利益，单独收受两人给予的财物567万元，与被告人崔丽华共同收受郑某给予的财物225万元，共计人民币792万元。
据悉，罗卫国应退赃款1005万余元，实际退赃款634.9万余元，崔丽华应该退赃495万元，实际上退赃款120万余元。
罗卫国及情人均因受贿及利用影响力受贿获刑
记者了解到，桂林市中院审理后认为，被告人罗卫国身为国家工作人员，利用职务便利，为他人谋取利益，单独或伙同被告人崔丽华非法收受他人财物，两人行为均已构成受贿罪；罗卫国离职后利用其原职权或者地位形成的便利条件，通过下级单位国家工作人员职务上的行为，为请托人谋取不正当利益，单独或伙同被告人崔丽华收受请托人财物，数额特别巨大，两人行为还构成利用影响力受贿罪。两被告人应数罪并罚。
在共同犯罪中，罗卫国起主要作用，是主犯，应当按照其所参与的全部犯罪处罚，崔丽华起次要和辅助作用，是从犯，对其减轻处罚。
罗卫国到案后，揭发他人犯罪行为，有立功表现，可对其从轻处罚。罗卫国主动交代了侦查机关尚未掌握的大部分受贿和利用影响力受贿的事实，结合两被告人退赃情节，依法从轻处罚。
法院一审以受贿罪判处罗卫国有期徒刑13年，并处没收个人财产100万元；以利用影响力受贿罪判处罗卫国有期徒刑7年，并处没收个人财产100万元，决定执行有期徒刑15年，并处没收个人财产人民币200万元。
法院以受贿罪判处崔丽华有期徒刑7年，并处没收个人财产10万元；以利用影响力受贿罪判处其有期徒刑5年，并处罚金10万元，决定执行有期徒刑10年，并处没收个人财产人民币10万元、罚金人民币10万元。对扣押在案的犯罪所得赃款予以没收，上缴国库；尚未退出的赃款继续追缴。
两人都认为量刑重上诉均被驳回
记者了解到，一审判决后，罗卫国和崔丽华均不服，提起上诉。
罗卫国提出，原判决认定其受贿金额有误，有些应刨除；他与崔丽华不是共同受贿，他不应该对崔丽华收受的受贿款承担刑事责任；他有检举、揭发等重大立功情节，原判决仅认定了部分立功行为，没有认定其有重大立功表现。原判对他量刑过重，对其判处没收个人财产200万元过重。
崔丽华也表示原判量刑过重，指控她的受贿金额有误。她说她的行为不构成利用影响力受贿罪；原判决没有明确她的退赃数额，她不应当对罗卫国收受的赃款承担退赃的连带责任。
两人的辩护人也提出了辩护意见，但最终法院均未采纳。
对于罗卫国提出他有重大立功的问题，法院经查，罗卫国在一审期间检举班某涉嫌犯罪的线索，查证属实，一审已认定构成一般立功。二审期间，罗卫国继续检举其他人员涉嫌犯罪的材料，法院已移交给广西自治区纪委，但庭审时尚未查实，因此罗卫国的行为不构成重大立功。
广西高院审理认为，罗卫国身为国家工作人员，利用职务便利，为他人谋取利益，单独或伙同崔丽华非法收受他人财物，两人行为均已构成受贿罪；罗卫国离职后利用其原职权或者地位形成的便利条件，通过其他国家工作人员职务上的行为，为请托人谋取不正当利益，单独或伙同崔丽华收受请托人财物，两人行为构成利用影响力受贿罪，原判定罪准确，二人均犯数罪，应数罪并罚。
罗卫国受贿、利用影响力受贿数额特别巨大，崔丽华受贿数额巨大，原判认定崔丽华犯二罪数额特别巨大不当，应予纠正。
最终，广西高院终审裁定，驳回上诉，维持原判。

记者了解到，2014年7月，中央纪委监察部网站通报了6起纪检监察干部违纪违法典型案件，其中包括广西国土厅原纪检组长罗卫国严重违纪违法案。
通报指出，2006年至2013年，罗卫国利用职务便利，通过向有关人员打招呼方式，为他人在取得土地整理项目、免予行政处罚等方面提供帮助，收受贿赂共计1682万余元人民币；收受礼金50万元；与他人通奸。
