湖北日报（荆楚网）消息（特约记者谭桂林、楚天都市报记者陈俊）恩施市工商局下属分局一副局长，请工人在自家小区旁的山坡废弃洞穴里开挖建车库 ，不料施工过程中石块塌方垮下，一名63岁的工人被砸中不幸身亡。24日，死者家属与业主及物业方进行协商，就赔偿事宜达成一致。记者了解到，当事业主系恩施市工商局稽查分局副局长向某。
事发地位于恩施市城区叶挺路的日内瓦小区，这里依山而建，小区四周都被小山包围。24日上午，记者来到小区旁的山坡看到，这里沿坡都有一排挖开的山洞，有的用水泥砌好被业主用于车库或仓库。靠里有一个杂草丛生的山洞就是发生悲剧的地方，一片石块散落在洞口周边，一条拉起的警戒线将洞口围住，脚手架和水泥袋还在地上。家属介绍，死者王某是恩施本地六角亭的人，家庭比较困难，一直靠在外打零工为生。20日，王某接到工友李某邀约，来到小区山洞施工，主要是将洞口及洞内拓宽加固，业主希望将这里整理为停车场和仓库。22日上午 10时许，洞口上方山石松动引发塌方，正在施工的王某被石块砸中，眼疾脚快的李某快速跑开逃过一劫，事后王某不幸身亡。
小区物业管理方互信物业公司一名工作人员向记者介绍，这片山洞是多年前就有的，后来城中村改造建起成片小区，山洞也就逐渐废弃成了遗留问题。开发商建设时，山体并不在小区范围内，但山坡紧挨着小区，于是有的业主就通过开发商取得山洞处置权，自行改造。出事的山洞存在了多年，以前一直荒废，业主入住时就取得开发商同意可以使用。近期业主找工人施工，打算将山洞修整后建成车库和仓库，不料发生意外事故。对于事故的责任 ，物业公司表示，山洞属于业主私人进行改造，并不属于物业管理范畴，而且山体在隔壁另一个小区范围内，为此也多次发生权属纠纷。现在物业正在积极配合相关部门处理善后，业主也比较配合。
恩施市清理办主任聂忠荣告诉记者，事发的山洞是历史遗留，业主也并非在山体上新开挖洞口施工，所以不属于两违办执法管理范畴，目前主要由物业方及业主联系死者家属妥善处理善后赔偿事宜。
记者了解到，当事业主向某，系恩施市工商局稽查分局副局长。昨日下午，记者给向某打电话和发短信，但都被婉拒。
恩施市工商局局长潘超表示，此事属于个人行为，与向某的职务无关，向某目前还是稽查分局副局长，但借调至市金融办工作。接到消息后，局里第一时间组织开会讨论善后，目前已预借部分资金给向某用于赔偿，今后几年从向某工资奖金扣除，并以其房产担保。下一步，该局还将对此事全面调查，做到合理合法妥善处理，保证群众利益得到维护。
死者家属昨晚告诉记者，已经与向某就赔偿达成一致，签订协议。
记者在恩施市走访发现，这里群山环绕，很多小区都依山而建，在山坡边挖山洞用作车库现象比较普遍。多名市民介绍，有很多山洞年代久远，希望政府部门加强安全管理。
恩施市六角亭办事处表示，办事处将下达整改通知书，马上在辖区内进行拉网式排查，对类似存在安全隐患的山洞进行加固、封存。以此为鉴，严防安全事故再次发生。
