　　案发

　　菲律宾籍女子出逃获救

　　2015年7月14日，菲律宾女子Rechel与另5名菲律宾女性经过谋划，准备逃出丰台区岳各庄中堂紫熙台小区住地，准备前往菲律宾大使馆求助。但最终只有Rechel一人成功逃脱，在路上，她遇到执勤民警，于是报警说明了情况。

　　丰台检察院指控，2014年底至2015年7月中旬，吕某和李某勾结国内及境外人员，以虚假的签证申请材料，策划、组织6名印度尼西亚籍女性，和8名菲律宾籍女性非法入境来华，准备在北京从事家政服务。

　　起诉书披露的信息显示，吕某和李某将这些外籍女子接入京后，将其护照收走，要求他们在房间内不许外出，直至雇主将其带走。这些外籍女子包括了Rechel和她的同伴们。

　　被告人称北京“菲佣”需求大

　　2月23日上午9时许，该案在丰台法院开庭审理，已取保候审的吕某和李某均表示认罪，声称此前并不清楚自己的行为会触犯法律。

　　吕某在庭审中表示，2015年7月，自己和李某在岳各庄桥附近租了3套房子，经营外籍家政服务业务，利用旅游签证或者商务签证，为印尼和菲律宾籍女子在国内找保姆家政工作。

　　“我知道这事是违规的，以为只是工商那边会罚款，就是大家说的‘黑中介’，要是早知犯法我们就不会做了”，吕某称，因为北京雇主对“菲佣”有较大需求，两人为了赚钱才做起了这个行业。

　　吕某及李某的辩护人则认为，案件中办理签证的境外人员应是主犯，吕某、李某的行为区别于“蛇头”，只是通过在国内为入境人员介绍工作而获利，处在组织他人偷越国边境行为链的末端，应属从犯。

　　该案当庭未宣判。

　　探员揭秘

　　非法外籍家政产业链是如何敛财的？

　　“我俩在中关村卖相机时认识了一个女老板，先是跟着她一起做赴美生子，然后又开始做菲佣生意”，据李某和吕某供述，2015年4月，他们与女老板产生矛盾后开始单干。

　　记者了解到，吕某还成立了北京神州美星商务咨询有限公司，打出“菲佣不可”的广告，在网络上发布信息，提供外籍女性家政服务项目。

　　被告人：赚雇主中介费扣佣工工资

　　在李某和吕某掌控的外籍女子中，菲籍女子办理商务签证、印尼人来华办理旅游签证，前者在华停留时间为90天，后者时间更短。这些外籍女子均由国外的中介介绍人员，并办理护照和签证等。

　　“中介每介绍一人，我通过网银支付13000元，包括签证费、机票和好处等”，吕某称，介绍人通过微信把照片发过来，由李某拿着照片在机场接人。

　　入境后，吕某的公司会扣下这些外籍女子护照，包吃包住，但不许她们外出。同时对外籍女子进行家政培训，再由公司员工与雇主签订帮佣服务协议，从事家政服务工作。并以人民币2万至5万元不等的价格，收取相关雇主的中介费用。

　　“他们的工资在4000元到4500元之间，开始六个月雇主直接把工资打到我们卡里，每月扣除3000元，再将剩余的钱转回她们在国内的账户，扣款用来抵押来华的签证机票等费用。”吕某称，为这些外籍女子找到工作后，会把她们的护照交给雇主，如果签证过期，由雇主决定是否办理续签或者居留许可。

　　“菲佣”：护照被扣出门会被警察抓

　　李某称，公司一共介绍了30多名外籍女子在国内从事保姆工作，从检方出具的名单中看到，这些人中岁数最大的42岁，最小的在19岁，其中有少数会流利说出中文。

　　“大学毕业后，听说中国工资很高，就想去中国打工赚钱，我们跟着中介去出入境办理护照，只是签字，也没有看到护照，也不知道什么时候怎么办的签证。来华后的前六个月工资需要每月扣除3000元作为中介费，我同意了。”名为Royani的印尼籍女子在笔录中称。

　　由于Royani中文说得不错，吕某便没有让他见其他雇主，而是将她留在公司作为翻译，同时负责管理其余菲佣。她有照顾孩子的经验，同时也被安排教会其他人。

　　Royani的行动相对自由，但也仅被允许在屋内走动，不允许出门。后吕某妻子怀孕，Royani还被要求照顾吕某的妻子。

　　“他说是前六个月每月支付我5000元的工资，每月扣除4000元，偿还护照、签证机票之类费用，但实际没有给过任何工资。我护照被扣押，假如我出门走了，警察会抓我。”Royani还向讯问人员表示，自己知道旅游签证在中国是不能工作的，后来过期了，也没有办理签证或者延期。

　　外籍家政非法 仍有家政公司运作

　　据审理此案的法官介绍，正规在华务工人员，需要劳务部门相关证明。但是根据中国出入境管理的行政规定，未经允许外籍人员在华不能从事这种低端的劳务，比如保姆之类，其实就是“打黑工”。

　　记者在网页上以“菲佣”为关键词进行搜索，可以看到很多家政公司都有菲佣、缅佣或者印佣。深圳一家名为“英伦女佣”的家政公司表示，自己公司主要的工人为缅佣，价格在每个月4500人民币到6000之间，中介服务费在20000块到28000块之间。

　　“我们家这个缅佣，来的时候也不会中文，教了一周就差不多了，她们学得都很快的。她们英语好，能给孩子一个好的环境。其实这些中介都是违法的，国内是不允许做外佣中介的，这些佣人过来都是护照过期的黑户。”该公司一位雇主称。

　　2月23日中午，记者探员以雇主身份，与另一家名为“佰赢国际家政”客服约定，去公司面试外籍家政人员。该公司位于丰台区的办公地点是一个30多平米左右的跃层，中介人员叫来两名外籍佣工，并要求她们做自我介绍。

　　两名女子个头不高，皮肤相对较黑。公司提供的资料显示，她们年龄为43岁和27岁，分别来自菲律宾和缅甸，之前都有在台湾或是香港、澳门工作过几年，说英语，但也会简单的中文。

　　中介人员向记者探员表示，国内的外佣都是护照过期的黑户，只要雇主不带佣工出国，在国内乘坐火车飞机都没问题。彼此之间只是一个简单的雇佣关系，不存在太多牵连。
