　　宁夏银川市西夏区党委原副书记、区长李维国，因受贿罪和高利转贷罪，被一审法院判处有期徒刑6年3个月，罚金80万元。李维国不服上诉。

　　记者今日获悉，宁夏回族自治区石嘴山市中级人民法院终审裁定驳回上诉，维持原判。

　　记者了解到，一审庭审时，李维国认罪。公诉人提供了李维国2016年1月26日写的一封悔过书。

　　“我的行为已构成违法犯罪，我对不起组织多年的培养教育，无颜面对身边的同事，无颜面对妻子儿子，无法在80多岁的老父亲身前尽孝，无法参加儿子的婚礼，我名誉扫地，我咎由自取，每每想到这些，我的心在滴血泪在流淌。我走上违法犯罪的道路主要有三个方面：

　　第一理想信念动摇，没有领会各种精神实质，学习会上说一套会下做一套，成为名副其实的‘两面人’；

　　第二拜金主义思想浓重，平时满脑子想的就是多挣钱，在贪欲驱使下觉得倒房子吃利息不影响，违规不违法，最后一步一步收受他人财物甚至伸手向他人索要财物；

　　第三是享乐主义抬头，缺乏自我完善、自我管理。”

　　作案揭秘

　　索贿受贿为情人买房买车位

　　一审法院审理查明，被告人李维国在担任银川市金凤区政府副区长、西夏区政府区长期间，利用职务便利，索取或非法收受他人200万元，并为请托人谋取利益。

　　2010年至2013年期间，李维国收受银川力鼎房地产开发公司副总经理孙某给予的16万元财物，帮助其承揽的金凤区宁安宜居项目工程、西夏区芦花洲土地增减挂钩项目尽快拨付资金。

　　李维国帮助宁夏悦海国际投资建设集团董事长刘某挂靠的宁夏长城集团房地产开发公司中标建设项目。随后，李维国为给其特定关系人张某购买银川市的房屋，向刘某提出解决132万元房款和20万元车位款的要求，刘某均满足了其要求。

　　2013年至2015年期间，李维国先后7次收受宁夏业通建设工程有限公司经理李某送的现金共计32万元，为其顺利承揽西夏区政务中心、贺兰山西路街道办事处、残疾人托养康复服务中心、兴泾镇泾华园安置区三期项目工程提供帮助。

　　案发后，李维国向司法机关上交赃款220.7万元。

　　据李维国供述，2010年4月份和2011年1月，力鼎房地产开发有限公司的副总经理孙某通过银行转账的方式送给他8万元，让他帮忙承揽宁安宜居工程尽快拨付工程款。此后，他向金凤区财政局的范某打招呼，让孙某尽快拿到宁安宜居工程款。

　　2012年”十一”国庆，李维国和孙某等人在上海旅游期间，孙某送给李维国5万元；2011年至2013年每年春节前，孙某每次都送给李维国10张面值1000元的购物卡，为感谢他对公司的照顾。

　　据李维国情人张某证实，2011年3月、6月，李维国准备给她购买银川市某小区的房屋和停车位。在此过程中，李维国安排她从刘某手中拿到132万元，用其中的100万元支付了房款和车位，32万元李维国拿走了。2014年下半年，她以173万元的价格将房子和车位卖给了朋友。

　　据银川市西夏区建设交通局局长吴某证实，2014年7月，在西夏区残疾人托养康复服务中心工程开标前的几天，时任西夏区区长李维国给他打招呼让关照李某。后来在李维国的帮助下，李某的业通建设工程公司顺利中标。2014年九十月，李维国又向吴某打招呼，让其在另一个招标中关照业通公司。吴某怕影响不好没有按照李维国的要求提供帮助，但后来业通公司仍中标了该工程。

　　据宁夏自治区纪委关于李维国案件的情况说明证实，李维国在接受组织审查期间，坦白了与张某存在不正当两性关系、拥有多套房产、收受孙某16万元等违纪事实，并主动交代了部分受贿款违纪问题。

　　套取金融机构的信贷资金转贷谋利

　　法院查明，被告人李维国还以转贷谋利为目的，套取金融机构的信贷资金，高利转贷他人获取非法所得36万余元。

　　经查，2009年至2013年期间，李维国以张某甲、来某的名义多次从宁夏银行、石嘴山银行取得授信贷款共计400万余元后，将款项借给银川力鼎房地产开发有限公司副总经理孙某、王某，并约定借款人每月以2万元至5万元不等的利息偿还，利息转存至孙某和王某名下，但实际均由李维国收取。李维国共获取非法所得36万余元。案发后，孙某向自治区监察厅上交了150万元涉案款。

　　庭审后，李维国近亲属已将高利转贷非法获利上交法院。

　　李维国供述，2012年5月，孙某找他帮忙周转资金，他让张某甲在银行办理授信贷款，从宁夏银行办理授信贷款共计150万元，并以张某甲的名义借给孙某的力鼎公司，并约定每个月利息5万元。后力鼎公司先后在张某甲的银行卡内存入95万元支付给他。此后他又以同样方式在银行贷款出借，在这期间产生利息36万元。

　　一审判决

　　因受贿罪和高利转贷罪获刑6年3个月

　　记者了解到，2017年1月12日，法院一审以受贿罪判处李维国有期徒刑6年，以犯高利转贷罪，判处有期徒刑1年，决定执行有期徒刑6年3个月，并处罚金80万元。对被告人违法所得200万元、高利转贷违法所得36万余元，予以没收并上缴国库。

　　终审判决

　　上诉称自首、退赃求轻判 法院裁定驳回

　　记者了解到，一审宣判后，李维国不服上诉。他表示对事实及罪名无异议，对量刑有异议。

　　李维国提出，自治区纪委不是现行法律体系中的”办案机关”，他在检察机关主动供述了受贿罪的全部事实，应认定为自首。自己积极退赃，应从轻处罚。

　　记者注意到，二审法院审理查明的事实与原判认定事实一致。法院认为，李维国身为国家机关工作人员，利用职务便利，索取、非法收受他人财物200万元，其行为构成受贿罪；其以转贷谋利为目的，套取金融机构信贷资金后高利转贷他人非法获得36万余元，其行为构成高利转贷罪，应数罪并罚。

　　关于李维国上诉认为”自治区纪委不是办案机关，其在受贿犯罪中应认定为自首”的意见，法院认为于法不符，不能成立。因原判在量刑时已对退缴全部受贿款及高利转贷违法所得予以考虑，故法院认定原判量刑适当。

　　2月14日，宁夏回族自治区石嘴山市中级人民法院终审裁定驳回上诉，维持原判。
