如果将阿里巴巴向全社会公开呼吁“像治理酒驾那样治理假货”视为打假的振臂一呼，马云就一定会是对假货最坚定的宣战者。
马云写到：“我建议参考酒驾醉驾治理，设想假如销售一件假货拘留七天，制造一件假货入刑，那么我想今天中国的知识产权保护现状、食品药品安全现状，我们国家未来的创新能力一定会发生天翻地覆的变化。”
马云在微博中表示，这几年自己认为最经典的司法进步就是酒驾治理。假如没有“酒驾一律拘留、醉驾一律入刑”的严刑竣法，今天中国要多出多少马路杀手！再看假货，绝大部分制假售假者几乎不承担法律责任，违法成本极低而获利极丰，很难想象假货如何才能打干净！

马云呼吁说，假如改变入刑标准，治理假货的结果肯定会大不一样：社会会形成共识，司法机关有法可依，政府部门杜绝权力寻租；更重要的是这代表了我们国家对知识产权的保护，对创新的决心和真正的行动，代表了我们社会的重大进步！因为假货对中国的伤害，远远不是我们看到的假货本身，而是对创新的伤害、对勤奋诚信之人的伤害，对国家未来的伤害。
马云一直毫无保留的参与及支持打假。在2016年3月阿里巴巴打假誓师大会上，马云将阿里巴巴每年投入10亿、运用最先进大数据防控模型的2000人专业打假队伍称为“打假国家队”，因为“假货最大的伤害是对整个中国社会的伤害。我们不仅仅为阿里巴巴而打，为中国而打，还在为我们的后代而打。”
马云对于加重刑罚治理假货的呼吁由来已久。2015年他在接受新华社记者采访时说：“我们需要的是法律的完善，机制的建立，提高造假者的成本，让不诚信的人寸步难行，让有能力的中国制造创出自己的品牌。这是阿里巴巴对待假货的终极目标。”
2016年6月马云在华尔街日报发表署名文章《阿里巴巴保护知识产权的立场及思考》，对全球消费者表示：“阿里巴巴绝不姑息纵容而是坚决打击假冒商品。品牌商和其知识产权必须受到保护。我们对侵犯他人知识产权的行为零容忍，现在不会，将来也不会”。在今年1月举办的达沃斯论坛上，马云则用“与人性贪婪的战争”来比喻打假，称利用大数据和新技术与全世界通力协作是赢得战争的方法。
正在召开的中国两会，代表委员们也在关注网购平台打假问题。3月4日，多次提出影响广泛提案的中国政协委员朱征夫向媒体表示，将在两会期间提交《关于对制假售假行为加大打击力度的提案》，建议加重对制假售假的刑罚处罚。

“醉驾入刑”到今天五年多，酒驾醉驾引起的事故大幅减少，大家开始形成拒绝酒驾醉驾的自觉，“醉驾入刑”推动了多大的司法的进步和社会进步！制假售假，本质上是一种“偷窃”行为。对于小偷，自古以来是非曲直分明，但是对于偷知识产权，今天中国仍然缺乏社会共识。

今天，现实世界里的假货源源不断地从黑工厂中产出，像雾霾一样四面八方袭来，充斥在大街小巷。互联网首当其冲，网络平台当然应该识别、报警、拦截，但是如果不关掉黑工厂，治理污染源，雾霾永远不会消失，这道理明白而简单。阿里巴巴绝不会置身事外，但法律基石永远是根，制造工厂永远是源，从根开始，从源着手，才是我们国家从制造大国走向创新大国，从“嘴治”到“法治”的大道。
