  目前,中国在人才引进上还是存在很多制度障碍,管理职能分散、手续繁琐等问题给移民带来不少麻烦,也使不少国际人才望而却步

  再过不到一个月,4月1日,中国将统一实施外国人来华工作许可制度,这也意味着外国人来中国的门槛又降低了一级。


  在中国与全球化智库(CCG)理事长兼主任王辉耀看来,这一举措代表着中国的移民政策会更加开放。


  “中国绿卡”,即外国人在中国的永久居留证,因申请门槛高、发放数量少,一直被调侃为“世界上最难拿的绿卡”。


  而在上个月CCG发布的《美国移民政策收紧 中国可抓住机遇实施更开放的人才政策》研究报告(以下简称《报告》)指出,美国移民政策的收紧,对于正面向世界建立开放、包容和灵活揽才机制的中国是一个重大机遇。


  机遇


  《报告》认为,特朗普此前签署的“禁穆令”虽遭联邦法官封禁,但他仍坚持收紧美国移民政策,可能继续颁布“禁穆令”。再加上意将改革H-1B签证制度等风声,这一系列举措或将大量国际高端人才拒于美国门外。


  而这些人才无论是作为中国应对老龄化的“人口红利”,还是作为中国创新发展的“人才红利”,都是宝贵的财富。


  目前中国经济高速增长放缓,人口红利释放完毕,依靠创新和消费转型成为必走之路。


  《报告》认为,虽然中国的整体教育水平在提高,但是中国在“引智”方面的缺乏,一定程度上还是影响了科研和创新水平的提高。


  不过,这种现象也在近几年来不断改善,在业内看来,中国移民的门槛正在降低。


  今年年初,中国的移民政策改革再次引起关注。


  2月6日,中央全面深化改革领导小组第三十二次会议进一步要求实施外国人永久居留证件便利化改革,推动永久居留外国人在华资格待遇落实。


  据统计,2016年,中国公安部批准了1576名外国人在华永久居留,增幅达163%。


  而即将在4月1日实施的外国人来华工作许可制度也备受关注。


  新政将就业证和外国专家证两证合一,原《外国人入境就业许可》和《外国专家来华工作许可》整合为《外国人来华工作许可》,由国家外国专家局负责组织实施。据介绍,上海试点以后,人才引进状况有所改善,但管理职能仍未统一。


  对此,王辉耀认为,目前,中国在人才引进上还是存在很多制度障碍,管理职能分散、手续繁琐等问题给移民带来不少麻烦,也使不少国际人才望而却步。


  王辉耀建议,成立移民局,简化移民手续,放宽移民政策,以吸引更多外来人才。


  对于成立移民局的建议,中国国务院参事陈全生也表示同意。他认为,移民和人才吸引涉及很多部门,国家是时候需要一个统一的部门来协调实施了,也给外界一个更开放的形象。


  门槛


  “绿卡”制度是欧美发达国家在全球范围内开展人才竞争,吸引和留住高层次人才的一项重要制度。


  20世纪80年代以前,普通外国人在中国居住的身份问题主要靠居留证制度解决,但活动范围和居留时间受到严格控制,能在中国安家落户的外国人,大都需要特批。


  1985年是中国移民政策的分水岭,外国人入境出境管理法出台,把外国人在华居留分为“短期居留”“长期居留”和“永久居留”三类。


  为适应国家改革开放和现代化建设的需要,中国从2004年8月开始实施《外国人在中国永久居留审批管理办法》,即中国的“绿卡”制度。


  有申请“绿卡”需求的主要是两类人:在中国有工作需要,亲属、配偶在中国的。工作层面不仅包括任职,还有投资、特殊贡献等。


  申请者可以通过四种途径:在中国直接投资200万元以上、连续3年投资稳定且纳税记录良好;在中国担任副总经理、副厂长等职务以上或者具有副教授、副研究员等副高级职称以上以及享受同等待遇,已连续任职满4年、4年内在中国居留累计不少于3年且纳税记录良好的;对中国有重大、突出贡献以及国家特别需要的;亲属团聚。


  前两条都是最近两年下调的门槛,但依然有很多普通外国人被挡在外。


  2004年,中国政府将第一张《外国人永久居留证》送到美国老人寒春手中,当时她83岁,在中国已经生活了56年。


  2016年,美国篮球运动员马布里拿到中国绿卡,他为北京队4年内3次夺得CBA总冠军立下了汗马功劳,还是北京市第30位荣誉市民,北京市副市长张建东亲自给他颁发了“中国绿卡”。


  同年,大庆眼科医院俄罗斯首席专家波波娃·莉莉娅·安纳托里耶夫娜获得由中国公安部颁发的“外国人永久居留证”,成为黑龙江省首个以特殊人才身份取得永久居留权的外籍人员。


  然而,一个普通外国人想要拿到中国的绿卡并不是那么容易。


  王辉耀在接受法治周末记者采访时表示,中国的“绿卡”门槛高,标准高。


  “同时,中国的绿卡还采用追认式,来到中国的外国人几年后表现良好才能获得绿卡,但发达国家是以本国绿卡来主动吸引其他国家人才。”王辉耀对法治周末记者说。


  这与中国的移民政策门槛高不无关系。


  《报告》指出,现在中国虽然发放绿卡,但外国人入中国籍还是比较困难。中国留学生出国渠道很畅通,获得留学生签证、实习签证、申请绿卡,还可以申请入籍,他们的职业预期很清晰。


  但外国人来中国留学就不知道能否在中国工作,能否拿绿卡,甚至以后在中国成家能否加入中国籍,没有这些预期,对吸引人才很不利。


  北京理工大学法学院理论法学研究所教授刘国福,参与制定过中国出入境、技术移民、难民等多项移民领域的法律和政策,他在接受媒体采访时称,预计将来“绿卡”门槛要求会有显著改善。


  “原来的要求中职位是标准之一,必须是副总经理、副厂长以上的人才有资格申请,一个单位里当一个副总以上的就那么两三个人,年轻人几乎是不可能的。”刘国福说。


  改变


  不过,种种迹象表明,号称“史上最严”的中国永久居留证制度,近年来不断“松绑”。


  2012年6月30日,新的《中华人民共和国出境入境管理法》通过,当时就有中国公安部负责人表示,新法中的表述将“为逐步放宽‘绿卡’申请条件留下空间,有助于促进引智引资工作”。


  从2015年开始,中国移民管理制度框架已经开始搭建。


  在中央层面上,2015年3月发布的《中共中央中国国务院关于深化体制机制改革加快实施创新驱动发展战略的若干意见》指出,要探索建立技术移民制度,吸引海外高层次人才。


  2015年6月9日,中国公安部下发通知,决定扩大申请在华永久居留外国人工作单位范围,在国家认定企业技术中心等7类企业、事业单位任职,且符合相关条件的外国人,可申请在中国永久居留。


  地方层面上,中国公安部陆续推出了支持上海科创中心、北京创新发展、福建自贸区和广东自贸区建设及创新驱动发展的出入境政策措施,并扩大申请在华永久居留外国人工作单位范围。


  新出台的政策措施,最大的特点是机制更市场化、更量化。


  比如,以前必须进入各个人才计划,但现在,在北京工作,年薪达到50万元(纳税达到10万元)就可以申请绿卡。


  自2015年7月起,京、沪、闽、粤等地相继出台了涉及外国人签证、停留居留证件和永久居留证签发等出入境政策措施,以构建更加开放、灵活的人才制度环境。


  2016年2月,中央办公厅、中国国务院办公厅印发《关于加强外国人永久居留服务管理的意见》,提出实行更加灵活务实的外国人永久居留服务制度。


  一个月之后,中关村先试先行中国公安部推出的支持北京创新发展的20项出入境政策措施,为来华创新创业的外籍高层次人才提供出入境便利。


  中国国家主席习近平更是在2016年4月提出:“不管是哪个国家、哪个地区的,只要是优秀人才,都可以为我所用。”


  同年6月30日,中国正式加入国际移民组织(IOM,International Organization for Migration)。此举更加表明了中国要实施更加开放的人才引进政策。
