　　2017年3月20日，鄂尔多斯市中级人民法院依法对被告人金柱故意伤害罪一案作出一审宣判。

　　法院以故意伤害罪对被告人金柱判处死刑，缓期两年执行，剥夺政治权利终身。

　　法院经审理查明，被告人金柱与被害人红梅系夫妻，被告人金柱曾经多次酒后对被害人红梅有过家庭暴力行为。2016年4月5日下午下班后，被告人金柱因被害人红梅出去应酬而对其产生不满。当晚21时许开始，被告人金柱自己在家饮酒，期间多次给被害人红梅打电话，但被害人红梅的手机处于关机状态。至23时30分许，被告人金柱见被害人红梅仍未回家，便驾车出去找，驾驶至小区花池附近时看到被害人红梅从出租车上下来，出租车走后被告人金柱下车打了红梅几个耳光，致被害人红梅倒地后又踢了被害人红梅。之后被告人金柱将被害人红梅拉到自己车后座，自己坐在驾驶座上揪住被害人红梅的头发，将被害人红梅头部往车后门玻璃上撞击。被告人金柱在车内对被害人红梅实施完殴打后，二人回到家中，又因被害人红梅出去应酬的事情发生了争吵。2016年4月6日8时许，被害人红梅因身体不适向单位请假未去上班。当天13时40分许，被告人金柱起床后将儿子乌某某送到学校，返回家的途中到锡尼镇社保局巷内的“久久宏门市部”买了一瓶红云磁化粮食白酒，并在门市部内喝酒，喝完酒后，又买了一瓶红云磁化粮食白酒于15时34分许回到家中，在一楼的卧室内继续喝酒。15时40分许，被告人金柱在二楼与被害人红梅发生争吵，并再次殴打被害人红梅。后被告人金柱发现被害人红梅在二楼的卧室床边趴着，并口吐白沫。被告人金柱于18时56分拨打120急救电话，120急救人员赶到现场发现被害人红梅没有生命体征，经抢救无效而死亡。经鄂尔多斯市公安司法鉴定中心鉴定，被害人红梅系因头部多次受到钝性外力作用致颅内出血而死亡。被告人金柱在案发现场被杭锦旗公安局刑警大队民警抓获。

　　法院认为，被告人金柱因对被害人红梅出去应酬而产生不满，于2016年4月5日晚对被害人进行殴打，并于次日酒后再次对被害人实施殴打，致红梅死亡，其行为已构成故意伤害罪。被告人金柱与被害人红梅结婚后因酗酒的恶习，多次对被害人红梅进行家庭暴力，犯罪情节恶劣，手段残忍，社会危害性大，应予严惩。在综合案情事实基础上，法庭遂作出上述判决。

　　宣判后，被告人金柱当庭未表示是否上诉。
