去年4月和5月，仅有初中文化程度的王某利用北京亿美软通科技有限公司的“来抢”和北京易麦通电子科技有限公司“品质365”系统当中的漏洞多次获利，分别给以上两家公司造成9000元和60000余元的经济损失。
去年5月30日王某被逮捕归案，公诉方认为应以破坏计算机信息系统罪追究其刑事责任。
据王某称，他是在某微信群的一位网友手中得到这个可利用系统漏洞“充1分既得300”的软件的。得到这个软件后，王某为自己和朋友充了大量的话费，还用多余的话费在网上商城买了电脑和手机。
在庭审过程中，王某坚持称，自己只是“偷了”一点话费，不应被判为破坏计算机信息系统罪，而应被判为盗窃罪。据了解，王某之所以坚持这样表示，只因破坏计算机信息系统罪的量刑为5年以下有期徒刑，而盗窃罪的量刑为3年以下有期徒刑。
