　　央广网余姚4月6日消息（记者曹美丽 杜金明）据中国之声《新闻纵横》报道，浙江余姚是中国最大的榨菜生产加工基地之一，每年的三月底四月初，正值余姚榨菜可以收割的季节。今年，当地榨菜获得了十几年来少见的大丰收，这却让菜农们开始犯起了愁，榨菜产量骤增然而收购价格逐渐走低，远远低于政府制定的指导价，众多菜农陷入增产不增收的境地。

　　其实，为了避免出现菜农增产不增收的情况，几年前，余姚农林部门就鼓励龙头企业跟菜农签订收购合同，走订单农业之路。那么，被视为“对症下药”的订单农业为什么没能发挥作用，稳定住收购价格？

>菜农正在收割榨菜

　　“愁卖，到处在减价，基本上上午一个价，下午又减价。我们从5毛卖到现在3毛6。”在余姚市泗门镇楝树下村，张锋龙家里种了5亩多榨菜，往年每亩产量在7000斤左右，今年亩产超过1万斤，但由于价格持续走低，高产并没有给他们家带来更高的收入。

>榨菜收购点

　　由于担心价格一跌再跌，甚至担心没人收购，整个清明小长假期间，菜农们几乎是全家出动抢收榨菜。

　　余姚市农林局产业科副科长郑立东分析说，余姚农林局每年都会跟榨菜协会和收购企业一起，在榨菜收割的前一个月左右，根据预估的产量、品质以及市场需求情况，制定政府指导价。由于今年榨菜产量远远高于预期，导致政府指导价定的偏高；外地榨菜大量涌入后，市场出现饱和。

　　郑立东指出，原来预估的产量亩产7000—8000斤，现在是一万到一万二。一下子涌进来，翻池跟不上收购速度，后期收购有一些困难，老百姓排长队。

　　与榨菜园里气氛同样紧张的是榨菜加工企业的腌制基地。在余姚国泰公司一个榨菜收购点，菜农们用三轮车把刚收割的榨菜一车一车的运过来，上秤，倒入清洗池，再捞出来倒入腌制池。不少企业的腌制池容量已经严重不足，影响了收购速度。

　　国泰公司收购点一位姓姚的负责人说，3月下旬，就有外地榨菜以远低于政府指导价的价格进入当地企业，不少企业提前完成收购计划，不得不压低收购价格。

　　负责人说：“我们28号、29号开始收的，人家收4毛7、4毛8，我们5毛收。5毛一斤收了4天，现在他们价格压了，我们也压了。”

　　价格跌入谷底，菜农们也越发紧张，出现了集中抛售的局面，不少收购点要彻夜排队。

　　菜农出现卖菜难之后，不少企业主动承担社会责任，加高加深腌制池，甚至新建腌制池，继续收购。目前整个收购工作已经接近尾声。

　　郑立东说，从今年的情况来看，单纯靠政府指导价已经不足以保障农民的收益，余姚农林部门正考虑制订新的办法，比如在出现供过于求的年份，价格严重低于政府指导价时，采取类似订单农业的形式，企业收购时，一部分按政府指导价收购，一部分走市场价格。

　　郑立东表示，要在维持基本指导价格的基础上，附加一些市场调节因素，综合考虑。比如，8000斤按照政府指导价收购，超出的部分按照市场价收购。

　　其实，余姚农林部门为了避免出现菜农增产不增收的情况，早些年就鼓励龙头企业跟菜农签订收购合同，走订单农业之路。郑立东说，榨菜常年都是供不应求，所以在实施过程中，农户履行合同的情况并不理想，企业的积极性就不高了。

　　郑立东说：“农户理所当然的毁约，价高就卖。订单对企业来讲，感觉可有可无，又花了很大精力，到收购时又没法制约农户。”

　　宁波大学法学院院长张柄生说，现在不少订单农业合同本身就非常不规范，在合同实际履行过程中，仍然是靠双方当事人的良心。如果有一方恶意违约，另一方很难利用合同追究责任。

　　张柄生建议，除了要加强诚信宣传，最重要还是要规范合同，增加违约成本。在合同签订过程中，要仔细考量各方面因素以及可能发生的不确定因素，对这些因素做出明确预判，对预判结果、风险、责任做出明确约定。
