“审片员”持证上岗，严把鉴定关

“鉴黄师”就是专门盯着“黄片”看，这活儿很容易，随便找个人就能干了！不少人有这样的揣测。其实不然，“鉴黄”工作门槛还很高，必须是已婚、年满45岁以上、心理素质极佳、能熟悉掌握法律及相关知识的一线骨干民警。目前，如皋市公安局仅有3名民警具有“鉴黄”资质。他们都经过严格培训，均持有江苏省公安厅发放的淫秽物品鉴定人员上岗证。

2007年，当时46岁的顾维宏为了案件审理需要，被抽调到这个岗位，一干就是10年。顾维宏坦言，他完全没有想到，开始以后才慢慢发现，这当中面临的各种压力出乎想象。

“鉴定的标准很严格，要对《国家新闻出版署关于认定淫秽及色情出版物的规定》十分熟悉，只要符合其中一条，就算是淫秽物品。”顾维宏说，其实民警在审看淫秽物品时，就像是医生，需要认真判定它到底有没有病？

近年来，传播淫秽物品手段也越来越隐蔽。顾维宏透露，很多淫秽视频夹杂在电视或电影的故事情节中，这无疑增加了鉴定的难度与工作量。为了确保鉴定结果无偏差，他们需要对平均时长超过50分钟的视频从头看到尾，工作量之大可想而知。

“如果因为快进，错过了淫秽色情内容，那鉴定结论就会错判或遗漏，都是对法律的不负责任。”因鉴定结果直接决定着案件的定性，顾维宏和另外两名同事对“鉴黄”工作十分谨慎，认真鉴定后才在鉴定书上签上自己的名字。

传播方式更新快，“鉴黄”也要与时俱进

谈到这个有些“尴尬”的工作，顾维宏直言，最初时难免有些难为情，不好意思跟朋友说自己负责的工作。但当面对工作时，他脑子里想的只有淫秽色情的标准。

随着社会传播方式的更新、发展，顾维宏和同事们在工作中的鉴定对象和使用的播放设备也在不断地发生着变化。“2007年的时候，我们遇到比较多的是扑克牌图片、光盘和录像带，现在最多的是网络图片和网络视频传播。”顾维宏打趣地说，从DVD机到各种播放软件，他们都用过了。

新媒体的迅猛发展，也给他们带来了不少挑战。现在一些案件中的鉴定内容被犯罪嫌疑人放在网络云盘上，有时云盘链接无法打开，不仅需要调取视频，还需要到网络公司调取后台数据，并掌握鉴定方法。玩微信、上云盘……年过五旬的顾维宏还在不断学习新事物。“不学不行呀，社会发展太快了，得赶紧追上，要不还真会影响审查鉴定工作。”

近年来，顾维宏和同事们在鉴定中遇到不少通过微信或其他社交软件传播淫秽物品的案件。犯罪分子层层发展代理员，代理员又通过社交平台出售或传播。只有熟悉了这些“新事物”，才能更好地掌握传播路径，发现传播内容，从而采取相应的措施。顾维宏笑着说：“我还要积极向小辈们学习，遇到技术难题，也会向市公安局网安大队以及专业公司的技术人员求教。”

在许多人看来，“鉴黄”民警的日常工作就是看片审查淫秽色情物品，这一职业轻松简单。顾维宏可不觉得。他说，鉴定淫秽色情物品远没有人们想象中的那般轻松，这只是其日常工作的一小部分，平时他们还必须负责其他繁重的警务工作。而且，鉴定淫秽色情物品需要遵循严格的程序规定，通常都是时间紧、任务重、压力大。

“其实长时间看，对眼睛和身体的伤害很大。几年来，我的视力明显下降。”顾维宏说，因为办案时间有严格规定，每次接到办案单位的鉴定委托，他都必须第一时间展开鉴定工作，通宵熬夜“看片儿”也是常有的事。

去年5月，如皋一名女性孙某在微信朋友圈出售淫秽视频，数量较大。专案组调查发现，该微信群是通过收取代理费发展代理，然后通过百度云分享和微信贩卖百度云盘账号、密码的方式销售淫秽视频。案件涉及中国13个省市2000余人。专案组于6月1日对中国13个省、市的主要犯罪嫌疑人，实施统一“收网”行动。捉获犯罪嫌疑人22人，查获含有淫秽视频的百度云盘30个，其中淫秽视频近5万部。

收到淫秽色情物品委托鉴定书后，顾维宏和另2名同事投入紧张的鉴定工作。因为鉴定量太大，还请来海安、通州、南通4名具有鉴定资格的民警一起参与。直到今年1月，这项审查鉴定工作历时半年，才宣告基本结束。顾维宏出具了淫秽色情物品鉴定书，随后案件被移交检察机关。顾维宏等人开具的鉴定书为定罪量刑提供了法律依据。截至目前，案件经检察院批准逮捕14人，取保候审8人。

谈时下热点——网络主播是否涉黄要综合判断

如今，网络直播火了，形形色色的网络主播为了博出位，也不断打擦边球，很多平台对主播表演和着装做出限制，比如“严禁女性刻意露出乳沟、臀部等敏感部位”，使得裸露程度有所收敛，但依旧有女主播顶风作案。在斗鱼TV、虎牙直播、花椒直播等平台上，不少女主播间让人侧目。

根据《刑法》第367条规定，淫秽物品是指具体描绘性行为或者露骨宣扬色情的诲淫性的书刊、影片、录像带、录音带、图片及其他淫秽物品。在“鉴黄师”顾维宏看来，鉴定包括网络主播的行为是否涉黄，主要是看有无露骨宣扬、描绘性行为的情节。在几种主要类型鉴定中，图片鉴定相对简单，主要看是否有裸露的生殖器官。对于视频，特别是打上马赛克的视频，则要结合场景、同期声和渲染性行为细节等因素综合考量。

去年，国家有关部门严处了斗鱼“直播造人”等涉嫌传播淫秽视频事件，对各大直播平台加大了监测力度。中国公安部在YY等重点直播网站设立网安警务室，工信部针对境内外50余款主流网络直播平台开展信息安全评估，并及时处置网络直播违法违规信息。

“网络主播的行为也受法律监管，我们也接受过相关鉴定。”顾维宏说，如果接到办案单位委托，“鉴黄”民警也对主播直播视频进行鉴定，如果鉴定属于淫秽色情物品，将依法进行处理。
