国家食品药品监督管理总局药品审评中心原副主任尹红章，手握生物制品临床实验的审批及药品注册申请的技术审评大权。而其妻儿也意识到了他的权力，这一家三口在2002至2014年间，共收取生物制药企业给予的财物共356万余元。而来自北京和上海的数家疫苗生产企业也因向尹红章一家行贿而卷入该案。日前，这一家三口受到了惩罚，北京市一中院一审以受贿罪判处尹红章有期徒刑10年。其妻郭某某因帮收150万余元，一审被判处有期徒刑3年，缓刑5年；其子尹某某帮收107万余元，一审被判处有期徒刑两年，缓刑3年。
妻子帮收150余万元被羁押
现年59岁的尹红章长期担任原国家药监局药品注册司生物制品处处长，主要职责包括组织拟订生物制品的注册管理制度和标准，并监督实施和承担疫苗监管质量管理体系评估的相关工作。2010年9月，尹红章开始担任国家食品药品监督管理总局药品审评中心副主任，负责生物制品审评方面的工作，分管生物制品药学部、研究与评价部等多个部门。
而尹红章正是利用任职药审中心和生物制品处的便利，为企业在药品申报审批事宜上提供帮助来谋取利益。2015年4月，尹红章被带走调查，两个多月后，国家食药监总局发布通知，免去其药品审评中心副主任的职务。
此外，根据检方指控，2002年至2014年间，尹红章的妻子郭某某明知尹红章利用职务便利为北京和上海的数家疫苗生产企业和生物制品研究所在药品申报审批等事宜上谋取利益，仍与尹红章共同非法收受或者索取上述公司给予的共计150余万元。2015年4月27日，郭某某因涉嫌受贿罪被羁押。
参观新房顺手拿走5万元
法院经审理查明，2002年至2014年间，郭某某明知尹红章利用职务便利，接受北京一家生物制品公司总经理尹某的请托，为该公司在药品申报审批事宜上提供帮助，与尹红章共同非法收受或索取尹某给予的钱款共计35万元。
尹红章称，他于1995年前后与尹某相识，因工作关系两人经常一起开会并由此熟识。2002年尹红章调任药品注册司生物制品处处长后，尹某的公司申报过甲肝疫苗、SARS疫苗、禽流感疫苗、手足口病疫苗、甲流疫苗等项目，尹某为了能在药品审批上获得照顾，两人之间一直有经济来往。
2006年上半年，尹红章分得住房一套，为装修新房，他和郭某某到尹某刚装修完的住处参观。其间，尹某给了他一个装有现金5万元的信封，尹红章直接将信封给了妻子。
“借款”30万元购买别墅
在2011年尹红章购买小产权别墅期间，他以借款为名向尹某索要30万元。尹红章称当时家中有钱，但由于妻子不愿意拿钱出来，于是他只能找尹某要了30万元。尹红章承认，他确实帮助尹某的公司推动过审批进程。
尹某在证言中称，他所在公司生产的疫苗属于生物制品，因为尹红章当时是药审中心副主任，对他的公司存在监管关系，所以尹红章张口借钱他不能不同意。他也知道尹红章虽然口头上说是借钱，但其实就是要钱。尹某称，他之所以送钱，就是为了让尹红章在药品审批方面能够关照他的公司。
收受80万帮企业加快审批
2007年至2014年间，尹红章夫妇共同收受北京一家生物医药有限公司负责人白某给予的80万元。尹红章称，2000年左右，白某成立了北京某生物医药有限公司，在他担任药品注册司生物制品处处长期间，他加快了对白某公司生产相关药品的审批进程，使相关药品于2005年获得新药证书，并于2008年获批上市。
白某为了表示感谢和维持关系，自2007年起至2014年，几乎每年节日期间都会以请客吃饭或送水果的名义给其送钱，每次送5万元至8万元不等，总数为80万元。白某称，之所以给尹红章送钱，目的就是为了在药品审评中获得他的帮助。
受贿25万帮企业打开销路
此外，尹红章夫妇还共同非法收受上海一家生物科技工程研究所法定代表人姚某给予的钱款25万元。尹红章称，姚某研究所主要生产销售小牛血清制品，他分管的药厂中有姚某的供货厂商。因销路不好，姚某想利用尹红章职务上的影响力帮她的产品提供销路。为此，姚某两次给其现金共25万元。
虽然尹红章称，他没有直接帮姚某推销过产品，但相关证言显示，上海一家采购单位所购的小牛血清主要来源于两家公司，其中一家便是姚某的公司。姚某个性比较张扬，多次宣称自己和尹红章关系很好。上海这家采购单位的领导也曾提到过，如果姚某公司的产品可以使用并检验合格，就用姚某公司的产品。
儿子炒期货“筹资”百万
尹红章的儿子尹某某于2007年从华东理工大学生物科学专业毕业。2010年初，尹某某经尹红章介绍认识了辽宁成大生物公司的总经理庄某。他告诉庄某，自己正在筹资做期货，问庄某是否感兴趣。庄某很快领会了对方的意图，2010年11月上旬，庄某分两次给尹某某转账共100万元，尹某某利用这笔资金开始了自己的期货生意。
此外，从2012年开始，尹某某就挂职在庄某公司的驻京办事处，虽然没上过一天班，但庄某依然按月给其“工资卡”内发1800元。
尹红章夫妇对儿子用药企提供的100万元炒期货心知肚明，尹红章也在自己的能力范围内为药企提供便利。2010年，辽宁成大生物技术有限公司向国家食药监总局申请人用狂犬病疫苗“2-1-1”注射方式，由于该公司申报的临床试验方案缺少一个实验数据，第一次审评会的意见是要求辽宁成大公司重做实验、重报审批。但在第二次审评会议上，由于尹红章的建议，决定先通过申报，并要求辽宁成大公司在产品上市后补做实验，该公司的申请就此顺利通过。
主动交代并退缴全部赃款
在2011年至2014年间，郭某某与尹红章还共同收受了北京一家生物科技有限公司法定代表人杜某给予的17万元。
尹红章称，他2010年就认识了杜某，2011年初他购买别墅时发现杜某也住在同一个小区，于是来往逐渐密切。因为他是药品审评中心主管生物制品的副主任，而杜某的公司研发生产疫苗，所以杜某刻意讨好他，并给他送过两次钱。杜某称，由于当时他的公司有几个疫苗正在审评中心审评，所以他希望尹红章在审批方面不要为难其公司。2012年左右，杜某的公司有多个项目获得了审批。
尹红章被控单独或和妻儿共计收受生物制药企业给予的财物共计356万余元，其中伙同妻子收取了150余万元，儿子则“助攻”了100万元。尹红章被查获后，主动交代了办案机关尚未掌握的大部分受贿事实，并退缴了全部赃款、赃物。
法院审理认为，尹红章身为国家工作人员，单独或伙同他人利用职务上的便利索取和非法收受他人财物，为他人谋取利益，其行为构成受贿罪。尹红章所犯受贿罪数额特别巨大，依法应予惩处。在尹红章伙同他人共同受贿的犯罪事实中，起主要作用系主犯，且在部分犯罪事实中具有索贿情节，依法应予从重处罚。
鉴于尹红章到案后，能如实供述司法机关尚未掌握的其他同种罪行，且涉案赃款、赃物均已追缴，故可依法对其从轻处罚。法院遂以受贿罪判处尹红章有期徒刑10年，并处罚金50万元。
尹红章的妻子郭某某在与丈夫的共同犯罪中起次要作用，系从犯，被法院判处有期徒刑3年，缓刑5年，并处罚金20万元。儿子尹某某也被认定为该案的从犯，被法院判处有期徒刑两年，缓刑3年，并处罚金10万元。
