经湖北省沙洋县人民检察院公诉，曾德权涉嫌受贿一案近日在沙洋县人民法院进行了公开开庭审理。
据检方指控：2007年至2015年，曾德权利用担任宣恩县委副书记、宣恩县人民政府县长、宣恩县委书记的职务便利，为他人在承建工程、项目资金拨付、工作职务调整等方面提供帮助，非法收受曾某等9人给予的人民币118.6万元和美元1万元。
帮人揽工程
担任手握重权的地方长官，项目工程成为绊倒曾德权的重要原因。
2009年上半年，时任宣恩县县长的曾德权视察当地一道路工程，其间认识了承接该工程的个体老板曾某。
当年7月，曾某手下的施工人员与电力部门发生矛盾，请曾德权协调处理。曾德权召集电力公司有关负责人与曾某化解矛盾，及时恢复了工地供电。
其间，由于该项目实际工程量远高于工程计算量，曾某多次要求发包单位宣恩县建设局重新核定工程量，并按实际工程量结算工程款，由于问题迟迟得不到解决，工程一直处于半停工状态。
2009年9月，曾德权组织召开县政府常务会议，决定由建设局和审计局委托有资质的机构对工程量重新评估审核，按实际工程量结算工程款。此后，该工程顺利推进，于2011年7月完工交付使用。
考虑到曾德权是县长，对其承接道路工程也很支持，2010年春节前一天，曾某带着情人以拜年名义来到曾德权家，为其送去2万元现金。同年11月，得知曾德权要到非洲考察学习，曾某再次为其送去1万美元。
2010年2月，宣恩县当年最大的政府投资项目宣恩县宣三线莲花坝至三河沟道路改扩建工程公开招标，曾某借中国葛洲坝集团股份有限公司资质参加竞标。评标过程中，出现了投标人在一标段和二标段同时得分第一现象，曾某公司在二标段排名第二。
时任分管副县长向曾德权请示后，按其授意由曾某所在公司递补中标二标段。
“招标文件中规定一个单位只能中标一个标段，并没有规定一家公司同时在几个标段都得分第一如何处理，我就和业主评委商量后去见了分管副县长并作了汇报。”参与该工程评定的交通行业专家评委陶某证言证实。
一来一回，双方往来变得频繁。
2010年至2015年，曾某以拜年或是祝寿等名义先后为曾德权送去人民币88万元，美元1万元，其中46万元用于曾德权为父母建房。
侦查期间，曾德权主动交代了组织未掌握的收受宣恩县某房地产开发公司罗某人民币5万元、收受房地产企业老板何某1万元、接受个体装修老板曾某某为其装修房屋计人民币约20万元等不法事实。
存侥幸心理
因涉嫌受贿罪，曾德权于2015年12月30日经湖北省人民检察院决定刑事拘留，2016年1月底经湖北省人民检察院决定逮捕，依法延长侦查期限两次共计3个月。
在看守所期间，曾德权写下数千字悔过书。长达10页的悔过书，记录了曾德权的受贿心理。
“在9年多的时间里，因自律不严，对一些社会现象产生错误认识，加之对法律缺乏应有的敬畏，先后收受他人所送财物折合人民币110万元左右。”曾德权在悔过书中写道。
在分析违法原因时，曾德权在悔过书中直言自己自律不严，身处县级权力中心，虽有警惕之心，但由于思想防线筑得不牢，往往只防大不防小，不注重细节。
“在这个过程中，不少企业老板每次给我送钱，绝大部分我都拒绝了，少部分没退掉的比较大额的资金我都上交了组织，但还有一部分数额不大，又是逢年过节收受的红包没有退回和上交，出现这种错误，主要是思想认识出了问题。”曾德权称。
长期从事行政管理工作，曾德权并非不知法不懂法，也并非不清楚违法后果。
回看9年多的受贿历程，曾德权直言，这么长时间应该有很多机会改正错误纠正违法行为，自己却一直抱着侥幸心理，错误地认为反腐往往是没有人检举就无从着手，这种形式的反腐犹如隔墙扔砖头，砸到谁就是谁，自己有一种砖头未必就砸到自己头上的侥幸。
受贿百余万
曾德权落马，始于省委巡视。
2015年10月，湖北省委第三巡视组在宣恩县巡视中发现县委书记曾德权涉嫌违纪问题，将线索转至湖北省纪委。纪检部门结合前期群众反映问题展开初步核实。
当年11月3日，经湖北省纪委常委会研究并报省委主要领导批准后，纪检部门对曾德权违纪问题立案侦查并对其使用“双规”措施审查。3日后，湖北省检察院对曾德权涉嫌受贿犯罪问题立案侦查。
经侦查查明，2007年至2015年间，曾德权涉嫌受贿折合人民币共计125.3824万元，其中人民币118.6万元、1万美元。
案件侦查期间，曾德权的妻子向荆门市人民检察院退缴赃款125.3824万元。除检察机关掌握的其收受曾某贿赂外，其他受贿事实均系曾德权主动交代。
“我身为国家公职人员，违反了国家法律，理应受到处罚。我不仅在事业有成的时候，失去了工作、理想、抱负和个人自由，而且在年富力强的时候，失去了报效国家和人民的工作机会，既对不起家人的亲情，朋友的友情，更对不起党和国家的培养之情，父老乡亲的希望之情。”面对公诉机关指控，庭审过程中，曾德全当庭表示诚心悔过，争取早日回归社会。
据介绍，此案作为沙洋县检察院与法院共同组织的示范庭，沙洋县检察院公诉部、侦察监督部全体干警及法院相关庭室法官参加了旁听。
本案将择日宣判。
□ 说“法” 警惕红包成贪腐导火索
纵观曾德权的贪腐道路，呈现出一种细水长流式的特征：首先是贪腐时间跨度较长，前后共计9年，其次是单笔受贿金额并不大。尽管如此，曾德权最后累积的贪腐数额仍然超过百万元，其间最值得反思的，就是曾德权所谓的红包。关于红包，《中国纪检监察报》在一篇文章中明确指出，“党员干部能不能收送红包等，不是一个模糊不清的问题”。令人遗憾的是，仍然有少部分人与曾德权的想法类似，在内心深处有意无意模糊红包的概念，将其归为人情往来、节日风俗的一部分，进而放松了对自己的要求，直至如曾德权一般在漫长的时间跨度中，心安理得、积少成多，收受了数量巨大的红包，走上不归路。
在信息技术日益发达、支付手段多元化的今天，对于红包问题尤需加倍警惕。借助新科技手段发放的红包隐蔽性、渗透性更强，数量累积起来更快，也更容易让人失去警惕、借坡下驴。去年，中纪委网站发布《被一连串“微信红包”砸开底线》一文，剖析了微信红包违规案例。“解铃还须系铃人。”新科技手段可能会让贪腐问题更复杂，但也可以用来加大对贪腐问题的防范查处力度。面对由来已久的红包问题及其种种新变化，要善于运用新科技手段开辟更多举报渠道、追查途径和宣教方式，避免红包问题在信息时代扩大化。 杜晓
