　　国家食品药品监督管理总局医疗器械监管司原司长童敏利用职权，为陈某等8人在企业经营、保健食品审批、药品审评等事项中提供帮助，并多次收受或同意其情妇苏某收受请托人现金、汽车、银行卡等共计316万余元。北京晨报记者昨天获悉，北京市二中院一审以受贿罪判处童敏有期徒刑10年，并处罚金50万元。

　　接受请托收受316万余元

　　一审查明，2000年至2015年间，童敏利用担任江西省南昌市政府党组成员、市长助理、江西省经济贸易委员会党组成员、副主任、国家食药总局食品许可司司长、保健食品化妆品监管司司长（以下简称保化司）、国家食药总局医疗器械监管司司长等职务便利，或利用其职权、地位形成的便利条件，通过其他国家工作人员职务上的行为，在企业经营、保健食品审批、药品审评、职务晋升等事项中分别为请托人毛某等8人提供帮助。为此，童敏多次收受或同意情妇苏某收受请托人给予的现金、汽车、银行卡等财物折合人民币共计316万余元。

　　2015年5月，原驻国家食药总局纪检组发现了童敏涉嫌受贿的线索。2015年8月28日，童敏被查获归案。

　　情妇收药企老板52万元

　　童敏被控的其中一笔受贿款与其情妇苏某有关。经查，2009年至2011年间，时任国家食药总局食品许可司司长、保化司司长等职务的童敏，接受杭州迪生医药有限公司董事长张某的请托，通过向时任浙江省食药局有关人员打电话等方式，为医药企业向国家食药总局申请保健食品转让、更名以及介绍张某、苏某等人销售虫草等事项提供了帮助。为此，童敏于2011年7月至2015年3月，先后在北京收受或同意其情妇苏某收受张某给予的钱款，共计折合人民币93万余元，其中50万元用于苏某购买奥迪轿车一辆。

　　张某的证言显示，2011年的一天，他来京和童敏与苏某一起吃饭。饭桌上，苏某向他提出需要一辆车并称奥迪Q5车不错。因当时知道苏某和童敏是情人关系，为了讨好她，便马上同意了。后从公司凑了50万元现金送给了苏某，购买的车登记在苏某名下。2011年到2012年间，童敏说女儿要去加拿大留学，张某从公司借了12万元兑换成2万加元，并作为他女儿出国的贺礼给了他。

　　苏某称，2011年，童敏推荐其到张某公司北京办事处工作后，她当着童敏的面提出北京办事处要买辆车，后张某支付了车款。张某是药企的老板，工作中有求于童敏。2011年上半年，三人一起吃饭时，张某提出公司想向同仁堂健康公司提供虫草。后来甘肃某药业的杨总找到她和张某，希望通过她和张某卖虫草给同仁堂健康公司。谈好以后，她共得到收益52万元。

　　以借为名索贿10万加元

　　2009年，时任国家食药总局食品许可司司长的童敏，在中国保健品协会召开的一次会议上认识了时任协会副会长的赵某。后赵某多次提出愿意帮助童敏。2010年5月至2011年7月，由赵某担任董事长的公司先后向国家食药总局提交碧生源牌清源茶、碧生源牌润元茶、碧生源牌思悦颗粒的申报资料，赵某向童敏提出对申报的产品加快审批进度，童敏答应尽力帮忙。2013年4月24日，童敏在上述碧生源牌思悦颗粒的保健食品注册审批表司领导复核栏签字同意批准。

　　2011年上半年，童敏前妻刘某说她和女儿想在加拿大贷款买房，童敏以借为名，要求赵某为其女儿支付10万加元（约合人民币60.883万元）的学费。同年，赵某委托他人支付了这笔钱。后童敏未予归还，亦未表示归还。

　　除了借钱不还，童敏借了车也不归还。2002年6月，毛某将一辆本田牌雅阁小轿车交给童敏使用，后童敏一直未归还。对此，童敏辩称毛某借车是出于私交，与办事无关。

　　一审被从轻判处十年

　　庭审中，童敏只认可收受了其中二人的钱款，对于其余指控则不认可。他称，对赵某公司产品的审批是正常履职，没有因借钱而为他谋取利益。张某给钱主要是因为其女儿出国留学、张某希望其帮他维系一些关系以及其与张某合伙经营虫草生意挣得利润，其没有明示或暗示张某为苏某买车。其未违规审批，未索贿，未给国家和人民利益造成损失。

　　法院认为，童敏利用职务便利，或利用其职权、地位形成的便利条件，通过其他国家工作人员职务上的行为，在企业经营、保健食品审批、药品审评、职务晋升等事项中为他人提供帮助，多次收受他人给予的财物共计316万余元，其行为已构成受贿罪。

　　鉴于童敏主动交代了小部分受贿事实，具有坦白情节；积极退缴全部赃款赃物，部分认罪，有一定悔罪表现，据此从轻判处童敏有期徒刑10年并处罚金50万；责令退赔违法所得316万余元予以没收，上缴国库。
